Overcoming "bottlenecks" in the implementation of the Law on International Treaties

Reduce and simplify processes and procedures in international treaty work

Minister of Foreign Affairs Le Hoai Trung stated that the development of the Law project is an urgent requirement to overcome the limitations and obstacles that are "bottlenecks" in the process of implementing the Law on International Treaties, focusing on: promptly institutionalizing the Party and State's policies according to relevant resolutions issued in recent times; supplementing specific regulations, shortening the procedures for signing international treaties to meet political , foreign affairs and operational requirements of Senior Leaders; regulating the order and shortened procedures for signing international treaties on official development assistance (ODA) loans and foreign concessional loans; clarifying a number of provisions in the Law on International Treaties to ensure consistent application of the law.

The draft Law amends and supplements 22 out of 80 articles of the 2016 Law on International Treaties, adds 2 new articles, abolishes 2 articles; amends and supplements 2 articles of the Law on Government Organization. The main contents focus on 3 issues: overcoming a number of current difficulties and obstacles related to the order and procedures for negotiating, signing, approving, ratifying, amending, supplementing, extending and implementing international treaties on ODA and preferential loans in accordance with the provisions of the law on public debt management; on submitting for permission, concluding negotiations, amending and supplementing international treaties, and archiving records of signing international treaties. Reducing and simplifying processes and procedures. Implementing decentralization and delegation of authority in the work of signing international treaties.

Examining this content, Chairman of the National Defense, Security and Foreign Affairs Committee Le Tan Toi said that the Committee agrees with the necessity of promulgating the Law amending and supplementing a number of articles of the Law on International Treaties for the reasons stated in the Government's Submission.

The amendment of the Law aims to promptly institutionalize the Party's guidelines and policies, especially the thematic Resolutions recently issued by the Politburo; at the same time, perfect the institutions, policies and laws on international integration in the new situation; reform administration, promote decentralization and delegation of power in signing international treaties; overcome " bottlenecks " in the current Law, meet the political requirements, foreign affairs and international integration of the Party and State.

The draft Law dossier is complete, in accordance with regulations, ensures quality, and is qualified to be submitted to the National Assembly for consideration and approval according to shortened procedures.

The Chairman of the National Defense, Security and Foreign Affairs Committee noted that the content of the draft Law is consistent with many major policies and orientations of the Party; thoroughly grasps and closely follows the requirements of innovative thinking in law-making work; basically ensures the unity of the legal system; and ensures compatibility with relevant international treaties to which Vietnam is a member.

The Committee agrees with the Amending and supplementing regulations to overcome difficulties and obstacles in practice. However, some opinions proposed to supplement regulations on responsibilities and handling measures in cases where the above regulations on time limits are not complied with; some opinions proposed to amend regulations on inspection and assessment of international treaties, in the direction of combining the process of appraisal and examination of international treaties to reduce processes and procedures.

Regarding decentralization and delegation of power, there are opinions suggesting continuing to research and review regulations to ensure clear decentralization and delegation of power, correct subjects and scope in practical implementation.
