Discipline leaders for signing labor contracts with teachers that are not in accordance with regulations

On October 26, the People's Committee of Binh Dinh province announced that it had sent a report to the National Assembly Delegation of Binh Dinh province on the results of handling the petition of voters of Vinh Thanh district (Binh Dinh) related to the situation of signing labor contracts for teachers that are not in accordance with the law.

According to the report, the People's Committee of Vinh Thanh District has requested agencies and units to seriously review the responsibilities of relevant groups and individuals when the above situation occurred. As a result, 2 units organized collective review of the leadership, the Department of Internal Affairs and the Department of Education and Training of Vinh Thanh District, and 18 individuals reviewed and learned from their experiences.

Specifically, 16 individuals who are principals and vice principals of schools were criticized for directly signing labor contracts for teachers that were not in accordance with regulations; 2 individuals who are the Head of the Internal Affairs Department and the Deputy Head in charge of the District Education and Training Department were criticized for not checking and guiding the signing of labor contracts for teachers that were not in accordance with regulations, and not promptly advising on the organization of recruitment of civil servants in the education and training sector.

In May 2023, at the meeting between the National Assembly Delegation of Binh Dinh province and union members and workers in the area, a representative of the Vinh Thanh District Labor Federation reported that there was a situation where teachers, due to not having a payroll, were only allowed to sign labor contracts, but each time they signed, the contract was only valid for 29 days, and after the expiration, they had to sign another contract. Some teachers had signed contracts with such terms for the past 2-3 years.

After that, the Chairman of Binh Dinh Provincial People's Committee assigned the Department of Home Affairs to preside over and coordinate with the Department of Education and Training, Vinh Thanh District People's Committee and related units to check the content of the above information.

According to the inspection results of the Department of Home Affairs of Binh Dinh province, the signing of the above temporary contract took place in Vinh Thanh district from 2021-2023. During the period of 2022-2023, the schools signed contracts with 57 teachers (25 kindergarten teachers, 29 primary school teachers, 3 secondary school teachers). The temporary contract form lasted for 29 days to avoid additional costs for compulsory insurance with a salary of over 4.6 million VND/person/month (including social insurance, health insurance, unemployment insurance, union funds)... The signing of this contract was agreed upon by the principals themselves, but the District Education and Training Department and the school did not report to the People's Committee of Vinh Thanh district.

The People's Committee of Vinh Thanh District said that it has issued and implemented a plan to recruit civil servants in public service units of Vinh Thanh District in 2023, in which the demand for recruiting civil servants in education and training is 40 targets.

To ensure teacher requirements for the 2023-2024 school year while waiting for recruitment of civil servants, school principals have signed labor contracts with teachers for no more than 12 months.
