According to the People's Committee of Ho Chi Minh City, Article 63 of Decree 102 stipulates the determination of land prices according to the land price adjustment coefficient method (coefficient K) for land allocated and leased by the State before the 2013 Land Law. In reality, the implementation of specific land price determination in Ho Chi Minh City currently has about 100 real estate projects applying the above regulations.
However, due to the time of determining specific land prices in the past (before the 2013 Land Law), the time was too long, so it was very difficult to collect old information as a basis for organizing the determination of specific land prices and it was almost impossible to do so.
Therefore, the People's Committee of Ho Chi Minh City has sent an official dispatch to the Ministry of Agriculture and Environment reporting on the problems related to the K coefficient method to apply to the above cases according to the provisions of Decree 102.

Afterwards, the Department of Planning and Land Resources Development issued instructions on the implementation of the K coefficient method for cases requiring specific land price determination. However, this method cannot be implemented because it is impossible to collect information on comparable properties of similar nature in the past to apply.
The Ho Chi Minh City People's Committee emphasized that the deadlock in the organization of determining specific land prices has become a bottleneck in the socio -economic development of Ho Chi Minh City in particular and the urban development process in the whole country in general. Up to now, hundreds of real estate projects in the city are in a state of freezing or suspending the next legal procedures, leading to many consequences.
To resolve the above difficulties and problems, the People's Committee of Ho Chi Minh City continued to send a dispatch to the Deputy Prime Minister and the Ministry of Agriculture and Environment. On August 15, the Government issued Decree No. 226 amending and supplementing a number of articles of the decrees detailing the implementation of the 2024 Land Law. However, the content of the People's Committee of Ho Chi Minh City's report and proposal to amend and supplement Article 63 of Decree No. 102 has not been amended and supplemented.
Therefore, to promptly resolve difficulties and obstacles, the Ho Chi Minh City People's Committee requested Deputy Prime Minister Tran Hong Ha to assign the Ministry of Agriculture and Environment and relevant ministries and branches to amend and supplement Article 63 of Decree No. 102 in the direction of allowing the application of coefficient K issued by the Provincial People's Committee in 2015. This ensures consistency with market prices and harmonizes the interests between the State and investors.
