Proposing the Ministry of Public Security to receive land violation records in Can Tho

(Chinhphu.vn) - The Government Inspectorate recommended that the Ministry of Public Security receive the records of violations of the Thot Not Industrial Park Infrastructure Construction Center; Wilmar Agro Vietnam Co., Ltd. and Truong Hai Group Joint Stock Company for the Ministry of Public Security to investigate and handle according to regulations.

Transfer the violation file to the Ministry of Public Security for investigation.

Specifically, on May 7, Deputy Inspector General of the Government Le Sy Bay signed and publicly issued Inspection Conclusion No. 138 on planning and implementation of construction planning, construction investment management and land management and use in Can Tho City.

Notably, the Government Inspectorate recommended that the Ministry of Public Security accept the records of violations of the Thot Not Industrial Park Infrastructure Construction Center; Wilmar Agro Vietnam Co., Ltd. and Truong Hai Group Joint Stock Company.

In addition, the Government Inspectorate recommended that the Prime Minister direct the review and handling of responsibility for the collective and individual leaders of Can Tho City People's Committee over the past periods who have loosened management, allowing violations to occur.

According to the inspection conclusion, in Can Tho city, there are 6 industrial parks in the planning approved by the Prime Minister, including: Tra Noc 1, Tra Noc 2, Thot Not, Hung Phu 1, Hung Phu 2 and Vinh Thanh phase 1.

However, the inspection agency discovered that investors in Tra Noc 1, Tra Noc 2, Thot Not and Hung Phu 1 had arbitrarily subleased land for one-time payments to 29 secondary investors, contrary to the provisions of the 2013 Land Law, while they themselves were only leased land by the State in the form of annual payments.

‎A special point clearly stated in the inspection conclusion is the violation of the Thot Not Industrial Park Infrastructure Construction Center when it had not been assigned land by the Can Tho City People's Committee, had not invested in technical infrastructure, but had signed a one-time land lease contract with two large enterprises: Wilmar Agro Vietnam Co., Ltd., paid more than 55 billion VND to re-lease 6.03 hectares of land, to build a factory on 4.45 hectares. Truong Hai Group Joint Stock Company: paid more than 52 billion VND to re-lease 2.56 hectares of land, to build a factory on 2.3 hectares.

It is worth mentioning that the above land lease contracts have not been approved by the People's Committee of Can Tho City for unit prices and have not completed legal procedures, but the enterprise has been handed over the land and started construction, causing serious legal and financial consequences.

Proposal to handle the responsibility of Can Tho City leaders of different periods

‎In the face of systematic violations that have lasted for many terms, the Government Inspectorate recommended that the Prime Minister request the People's Committee of Can Tho City to organize a review and clarify the responsibilities of collectives and individuals leading the People's Committee of the City through the periods. "It is necessary to clarify the responsibilities in lax management, lack of inspection and supervision leading to the use of land for the wrong purpose, illegal land leasing, land allocation when not qualified, causing budget loss and distorting the local real estate market," the conclusion stated. At the same time, the Government Inspectorate also requested that during the implementation of the conclusion, if any act showing signs of causing loss of state assets is discovered, the case must be immediately transferred to the police agency for handling according to the law.

In terms of economy, the inspection agency recommended and recovered a total of over VND463.8 billion to the state budget from violations in land leasing and land use that were not in accordance with regulations. Deductions when finalizing the project were over VND2.5 billion due to violations in construction investment. In addition, the Government Inspectorate also discovered that the management and use of public land in Can Tho City was still loose and ineffective. Some land plots organized auctions of land use rights and land lease rights that were not in accordance with regulations, lacked transparency, and were prone to negativity.

The Government Inspectorate requested the People's Committee of Can Tho City to seriously and promptly implement the inspection conclusions. Take measures to correct and rectify, and strictly handle organizations and individuals who violate the law.
