On the afternoon of May 16, the joint Public Security - People's Procuracy - People's Court of the province held a conference to review 3 years of implementing Joint Circular No. 01/2020/TTLT, dated June 1, 2020 of the Supreme People's Procuracy , the Supreme People's Court, the Ministry of Public Security, the Ministry of National Defense, the Ministry of Agriculture and Rural Development, the Ministry of Finance, and the Ministry of Justice regulating the coordination in implementing a number of articles of the Criminal Procedure Code on the management and settlement of temporarily suspended cases and matters.
The draft report and the presentations at the conference clearly stated: after nearly 3 years of implementing Joint Circular No. 01/2020/TTLT, the prosecution agencies of Ha Nam province have correctly assessed the current status of temporarily suspended case files, discovered existing problems in previous files, thereby having solutions to manage, overcome, and handle them appropriately, promptly, and in accordance with regulations; the preparation of case files has recently had positive changes, 100% of newly-arising cases and temporarily suspended cases have been established to ensure the correct order and procedures according to regulations.
The management and monitoring of temporarily suspended cases and incidents is increasingly scientific , systematic, and accurate, facilitating future monitoring and handling when there is a basis for reinstating or suspending the investigation due to the expiration of the criminal prosecution period. Along with that, the work of reviewing and inspecting temporarily suspended cases and incidents is regularly, continuously, and periodically carried out by the Procuracy and the Investigation Police Agency on a monthly basis. Therefore, when a case or incident has sufficient basis for reinstating or suspending without prosecution, the Investigation Police Agency and the Procuracy at the same level promptly discuss and agree to resolve it in accordance with regulations.
As a result, over the past nearly 3 years, the Ha Nam provincial inter-sectoral prosecution has reviewed a total of 227 cases of temporary suspension/temporary cessation of verification of information sources about crimes, of which 91 cases have been resolved, and 136 cases have been continued to be monitored and managed; reviewed a total of 1,128 cases/57 defendants with temporarily suspended investigations, of which 780 cases/40 defendants have been resolved (348 cases/17 defendants have been continued to be monitored and managed).
At the conference, delegates focused on discussing and presenting some experiences and measures in applying Joint Circular No. 01, and at the same time analyzed and clarified difficulties and obstacles in managing and resolving cases and incidents that have been temporarily suspended in the past.
Regarding the tasks in the coming time, the Ha Nam provincial inter-agency litigation agency determined: The two-level litigation agencies (Police - People's Procuracy - People's Court) within their scope, functions, tasks and powers continue to strengthen leadership, direction, proactively coordinate in the management and settlement of temporarily suspended cases and incidents. Assign experienced officers to be the focal point for establishing monitoring records, strictly managing, regularly adding information on the content of temporarily suspended cases and incidents to the monitoring book. Regularly review temporarily suspended cases and incidents that are still within the statute of limitations for criminal prosecution; assign investigators and prosecutors to carry out investigation and verification measures to promptly resolve the reasons for temporary suspension as soon as there is a basis for restoration in accordance with the provisions of law.
The Procuracy and the Investigation Police Agency at two levels regularly coordinate closely in managing suspended cases and incidents. Strengthen inter-sectoral inspection and self-inspection to promptly detect and take timely measures to overcome limitations and shortcomings in the management and resolution of suspended cases and incidents. Further strengthen coordination with agencies assigned to conduct a number of investigation activities and relevant agencies to continue to seriously and effectively implement Joint Circular No. 01, provisions of the Criminal Procedure Code and guiding documents to ensure strict, complete management and timely resolution of suspended and suspended cases and incidents./
