Some economic recovery support policies are not effective.

National Assembly Delegate Ta Thi Yen spoke at the group discussion session on the morning of October 24, 6th session, 15th National Assembly .

Participating in giving opinions on the implementation results of Resolution No. 43/2022/QH15, delegate Ta Thi Yen, National Assembly delegation of Dien Bien province, assessed: In the context of the socio -economic situation facing many difficulties, the policies that have been promptly applied in the past time have been welcomed by the business community and people as positive solutions to support production and business activities and economic recovery.

A series of policies such as lending through the Social Policy Bank to support job creation, maintain and expand employment; policies on tax, fee and charge exemption and reduction, especially value added tax (VAT) have been simultaneously implemented, contributing to encouraging people and businesses to overcome difficulties, gradually bringing the economy back to life and prosperity.

However, there are also some policies that have not achieved the expected results, such as the policy of supporting interest rates and development investment capital of the loan program for non-public preschool and primary education facilities, loans for development of ethnic minority and mountainous areas. The disbursement rate of the 2023 capital plan is very low, as of September 30, 2023, only reaching VND 50,739 billion, equivalent to 28.9% of the assigned capital plan, while the remaining time to implement the program is less than 03 months.

For policies that have been implemented ineffectively and disbursed late, delegates suggested that it is necessary to analyze, evaluate, and clarify the causes to learn from the situation assessment stage; to the research and proposal stage of policy development; and to organize implementation at all levels of decision-making and policy implementation. It is necessary to clarify the responsibilities of each level, each unit, and individual to ensure that public financial resources are used in a timely, economical, targeted, and most effective manner, avoiding waste, especially in the context of public financial resources being very limited and tight due to economic downturn and revenue decline due to the pandemic.

Regarding the results of the review of the system of legal documents according to the provisions of Resolution No. 101/2023/QH15 on the 5th session of the 15th National Assembly, delegate Ta Thi Yen commented that this is an unprecedented general review of the system of legal documents, with the largest scale ever for 22 key areas, including: laws on bidding, auctions, planning, public investment, management and use of land, public assets, state budget...

The total number of legal documents reviewed by the implementing agencies is 523, of which 16 documents have contradictory or overlapping provisions, and 104 documents have inappropriate or problematic provisions.

Delegates commented that these contradictory, overlapping, and inadequate documents and contents have not been fully and comprehensively listed, because some review results overlap with previously conducted and reported review results; contents that still have different opinions or require more time to classify, research, review, and evaluate have not been temporarily compiled and proposed for handling in this report.

"These shortcomings were not discovered through review, but were actually encountered in the implementation, and have now been summarized. These are the obstacles and shortcomings of the legal system, which are the cause of bottlenecks, barriers, and limitations to socio-economic development, and cause legal risks for those who organize implementation, and are part of the cause of the mentality of avoiding and fearing responsibility of a number of cadres and civil servants" - delegate Ta Thi Yen expressed her opinion.

On that basis, delegate Ta Thi Yen suggested that, in addition to studying and using the review results in the Government's Report submitted to the 6th session, as an input data source for building and perfecting the legal system in the coming time, it is necessary to continue to pay attention to handling the review results that have been conducted and reported previously, especially for the contents mentioned in the reports, resolutions on supervision and questioning of the National Assembly and the National Assembly Standing Committee. With the contents that have been reviewed but still have different opinions, it is recommended that there should be an early document explaining and guiding the application of the law to remove difficulties and obstacles in organizing implementation.

In addition, there must be solutions and sanctions to improve the effectiveness of law-making, including the stages of collecting opinions, participating in opinions and receiving opinions during the law-making process. Only then can the root of the problem be solved, ensuring the synchronization, unity, suitability and feasibility in practice of the legal system.
