Next, the National Assembly discussed in the hall the Report of the Supervisory Delegation and the draft Resolution of the National Assembly on the results of the thematic supervision of "the implementation of policies and laws on environmental protection since the Law on Environmental Protection 2020 took effect". Relevant Government members explained and clarified a number of issues raised by National Assembly deputies.
Previously, in the morning session on October 27, under the direction of Vice Chairman of the National Assembly Nguyen Khac Dinh, the National Assembly held a plenary session at the Hall, listening to Permanent Deputy Prime Minister Nguyen Hoa Binh present the Report on 3 projects: Law on Temporary Detention, Temporary Imprisonment and Prohibition from Leaving Place of Residence; Law on Execution of Criminal Judgments (amended); Law on Amending and Supplementing a Number of Articles of the Law on Judicial Records.
Chairman of the National Assembly's Committee on Law and Justice Hoang Thanh Tung presented the Verification Report on three projects: Law on Temporary Detention, Temporary Imprisonment and Prohibition from Leaving Place of Residence; Law on Execution of Criminal Judgments (amended); Law on Amending and Supplementing a Number of Articles of the Law on Judicial Records.
Member of the National Assembly Standing Committee, Chairman of the National Assembly's Committee on Law and Justice Hoang Thanh Tung presented a summary of the Reports on explanation, acceptance and revision of the four drafts: Law on Extradition; Law on Transfer of Persons Serving Prison Sentences; Law on Mutual Legal Assistance in Criminal Matters; Law on Mutual Legal Assistance in Civil Matters.
After that, the National Assembly discussed a number of contents with different opinions of 4 drafts: Extradition Law; Law on Transfer of Persons Serving Prison Sentences; Law on Mutual Legal Assistance in Criminal Matters; Law on Mutual Legal Assistance in Civil Matters.
During the discussion session, there were 9 turns of opinions expressed by delegates; in which, the National Assembly delegates highly appreciated and basically agreed with the contents that the National Assembly Standing Committee directed the agencies to closely coordinate to study, absorb, and explain the opinions of the National Assembly delegates who participated in the 9th Session as well as to collect written opinions from the National Assembly delegations, the Ethnic Council, and the National Assembly Committees. The opinions of the National Assembly delegates basically agreed with the contents that were absorbed and revised in the 4 draft laws. In addition, in order to continue perfecting the draft laws, the delegates focused on discussing the following specific contents:
Regarding the draft Law on Mutual Legal Assistance in Civil Matters: Scope of regulation; concept of mutual legal assistance in civil matters; principles of mutual legal assistance in civil matters; exemption from consular legalization; processing time limit and responsibility mechanism; monitoring, post-audit and reporting mechanism; legal value of results of mutual legal assistance in civil matters...
Regarding the draft Law on Extradition: Concept of extradition; application of laws and principles of extradition; ensuring specific principles in extradition; conditional extradition; cases that can be extradited; transit of extradited persons; mechanisms related to the death penalty; responsibilities of state agencies in digital transformation in extradition work; cases of refusal of extradition; handling of cases where foreign countries refuse Vietnam's extradition requests; regulations on final appeal and retrial of extradition decisions and decisions on refusal of extradition; detention of people in emergency cases before an official request for extradition; legislative techniques...
Regarding the draft Law on Mutual Legal Assistance in Criminal Matters: Principles of mutual legal assistance in criminal matters; language in the dossier requesting mutual legal assistance in criminal matters; scope of mutual legal assistance in criminal matters; ensuring safety; central agencies and procedures for mutual legal assistance in criminal matters; issues of taking online statements, collecting and providing evidence; post-audit monitoring mechanism; state management responsibilities for mutual legal assistance activities...
Regarding the draft Law on the transfer of persons serving prison sentences: Funding for the transfer of persons serving prison sentences; the issue of converting prison sentences to ensure the humane policies of our State...

In the afternoon of the same day, under the direction of Vice Chairman of the National Assembly Tran Quang Phuong, the National Assembly held a plenary session in the Hall, listening to the following contents: Minister of Science and Technology Nguyen Manh Hung, authorized by the Prime Minister, presented the Proposal for the Law on amending and supplementing a number of articles of the Law on Intellectual Property. Chairman of the National Assembly's Committee on Law and Justice Hoang Thanh Tung presented the Report on the examination of the Law on amending and supplementing a number of articles of the Law on Intellectual Property. Member of the National Assembly Standing Committee, Chairman of the National Assembly's Committee on National Defense, Security and Foreign Affairs Le Tan Toi presented the Report on explaining, accepting and revising the draft Law on State of Emergency.
Afterwards, the National Assembly discussed a number of content with different opinions of the draft Law on State of Emergency. At the discussion session, 12 delegates expressed their opinions; in which, the delegates basically agreed with the structure, the Report on explanation, acceptance and revision of the National Assembly Standing Committee; at the same time, the assessment of the content of the draft Law clearly demonstrated the innovation of thinking in law-making.
In addition, in order to continue perfecting the draft Law, delegates focused on discussing: Regulations on emergency situations; interpretation of terms; principles of operation in emergency situations; measures in emergency situations; procedural activities in emergency situations; prohibited acts in emergency situations; resources for response, relief, and support in emergency situations; authority and procedures for information control; command and control agencies for emergency forces, responsibilities of agencies, organizations, and individuals; authority of the Government, local ministries and branches; international cooperation; digital transformation activities in emergency situations; legislative techniques...
