The National Assembly discussed in groups a number of draft laws and draft resolutions.

On the afternoon of May 16, continuing the program of the 9th Session, National Assembly deputies continued to discuss in groups the draft laws on amendments and supplements.

Under the chairmanship of comrade Hoang Duy Chinh, member of the Party Central Committee, Secretary of the Provincial Party Committee, Head of the National Assembly Delegation of Bac Kan province, Discussion Group 11, delegates from the National Assembly Delegations of Bac Kan, Long An, Son La and Vinh Long provinces actively participated in the discussion and contributed many opinions to the draft Law amending and supplementing a number of articles of the Law on Handling of Administrative Violations; Draft Law amending and supplementing a number of articles of the Law on Promulgation of Legal Normative Documents; Draft Resolution of the National Assembly amending and supplementing a number of articles of the Internal Regulations of the National Assembly session issued together with Resolution No. 71/2022/QH15 of the National Assembly.

Commenting on the draft Law amending and supplementing a number of articles of the Law on Promulgation of Legal Documents, delegate Ha Sy Huan, member of the Provincial Party Committee, Deputy Head of the Provincial Delegation of National Assembly Deputies, requested the drafting agency to study and amend the regulations on the effective time of documents issued by the People's Council and People's Committee at the provincial level in the direction of specifying the effective time, to ensure feasibility and suitability with local implementation practices.

Reflecting the reality that many Government decrees have specified contents, but still require localities to specify them, causing difficulties and delays in promulgating and implementing policies, delegates also proposed to add regulations so that localities can immediately apply clear regulations of higher levels without having to issue additional detailed documents, if there is no difference in policies or specific spending levels. In addition, it is proposed to add a clause clearly stating that for normative documents of higher levels that have come into effect and that local documents do not need to specify, localities can immediately apply the regulations of higher-level documents, in order to create favorable conditions for the grassroots in implementing policies.

Discussing and giving comments on the draft Law, delegate Ho Thi Kim Ngan, member of the Provincial Party Committee and Secretary of the Cho Moi District Party Committee, reflected that in reality, the issuance of detailed regulations is often delayed, leading to a "legal gap". Therefore, the delegate suggested not to change the provisions on the validity of detailed regulations as proposed in the Draft, because the provision that "detailed regulations expire, except in cases where they are announced to continue to be effective" would be very difficult to implement, especially when guiding documents are often delayed in issuance.

Discussing the draft Law amending and supplementing a number of articles of the Law on Handling Administrative Violations, delegate Nguyen Thi Hue, Vice President of the Provincial Women's Union, suggested that it is necessary to carefully consider the assignment of sanctioning authority to cases such as inspectors, heads of inspection teams and heads of inspection teams because not all inspectors or heads of inspection teams have the authority to sign sanctioning documents or stamp.

Hue delegate said that the content of the penalty decision and the violation record are not consistent, and suggested reviewing or keeping the provisions on the content of the penalty decision or removing both, and including them in the guiding decree to ensure consistency.


Concerns about the regulation on publicly posting decisions on penalties against individuals and organizations at their place of residence are understood to mean private homes, commune People's Committee headquarters, cultural houses, or community activities. In particular, in mountainous areas, if the decision is posted at the commune headquarters or village cultural houses, it will be very difficult for people in highland villages to access it. Therefore, delegates suggested that this regulation should be carefully considered to ensure the legitimate rights of people, avoid misunderstandings, and cause difficulties in law enforcement./.
