Regulations on nominating candidates for the People's Council at the commune level in villages and residential areas.

The Standing Committee of the National Assembly issued Resolution 101/2025/UBTVQH15 providing detailed regulations and guidance on organizing voter conferences; nominating candidates for People's Council representatives at the commune level in villages and residential areas; and consulting, nominating candidates, and compiling lists of candidates for National Assembly and People's Council representatives in by-elections.

The regulations stipulate the following regarding the nomination of candidates for the People's Council at the commune level in villages and residential areas :

Content and procedures for nominating candidates from villages and residential areas to run for election as representatives to the commune-level People's Council.

1. The Head of the Front Committee, in coordination with the heads of mass organizations, will meet with the Party Secretary, village head, or neighborhood group leader to propose candidates from the village or neighborhood group to run for election to the commune-level People's Council, in accordance with the announcement of the Standing Committee of the Vietnam Fatherland Front Committee at the commune level regarding the allocation of the number, structure, and composition of candidates.

2. The Head of the Front Committee convenes and presides over a meeting of all members of the Front Committee to discuss and nominate candidates from the village or residential area to run for election as representatives to the commune-level People's Council.

3. The conference organization procedure is as follows:

a) The Head of the Front Committee introduces the purpose and requirements of the conference, appoints the conference secretary, and reads the announcement of the Standing Committee of the Vietnam Fatherland Front Committee at the commune level regarding the allocation of the number, structure, and composition of people from villages and residential areas nominated to run for election as representatives to the commune-level People's Council; the standards for People's Council representatives as stipulated in Article 5 of the Law on Organization of Local Government and the cases ineligible to run for People's Council representatives as stipulated in Article 37 of the Law on Election of National Assembly and People's Council representatives;

b) The Head of the Front Committee proposes candidates from the village or residential area to be nominated as representatives for the commune-level People's Council;

c) The conference discusses and comments on the person who is expected to be nominated as a candidate;

d) The Head of the Front Committee summarizes the opinions and conclusions of the meeting;

d) The conference adopts the minutes of the conference (according to Form No. 03/HNMT attached to this Resolution).

The voters' conference introduces candidates from the village or residential area to run for election as representatives to the commune-level People's Council.

1. The Head of the Fatherland Front Committee, in coordination with the Village Head or Neighborhood Group Leader, sends invitations to attend a voter meeting to nominate candidates from the village or neighborhood group for election to the Commune People's Council. The invited attendees include:

a) Voters or voter representatives of households. For areas with fewer than 100 voters, a general meeting of all voters must be organized, ensuring that at least 50% of the total number of voters summoned attend. For areas with 100 or more voters, a general meeting or a meeting of voter representatives of households may be organized, ensuring that at least 55 voters attend the meeting;

b) All members of the Front Committee;

c) Village head, deputy village head, or neighborhood group leader, deputy neighborhood group leader;

d) Representatives of the Standing Committee of the People's Council, the People's Committee, and the Standing Committee of the Vietnam Fatherland Front at the commune level.

2. The procedure for organizing a voters' meeting is as follows:

a) The Head or Deputy Head of the Front Committee presides over the voters' meeting, announces the reason for the meeting and introduces the delegates attending the meeting; introduces the purpose and requirements of the meeting; introduces the meeting secretary for the meeting to decide; reports on the number of voters invited and the number of voters present;

b) The meeting chair reads the announcement of the Standing Committee of the Vietnam Fatherland Front Committee at the commune level regarding the allocation of the number, structure, and composition of people from the village or residential area nominated to run for election; reads the standards for People's Council representatives as stipulated in Article 5 of the Law on Organization of Local Government and the cases in which individuals are not eligible to run for People's Council representatives as stipulated in Article 37 of the Law on Election of National Assembly and People's Council representatives;

c) A representative of the Front Committee reads the list compiled by the Front Committee of individuals from the village or residential area who are nominated to run for election as representatives to the commune-level People's Council. Voters may nominate additional candidates for the meeting to consider;

d) The conference discussed the nominated candidates;

d) The conference shall appoint a vote counting committee of 5 to 15 members;

e) The meeting decides on the official list of candidates nominated by the village or neighborhood group through a show of hands or secret ballot.

If the conference votes by show of hands, the vote counting committee will count and calculate the voting results for each nominated candidate.

In cases where the conference votes by secret ballot, the ballot for collecting voter opinions must bear the seal of the Vietnam Fatherland Front Committee at the commune level or the seal of the People's Committee at the same level. The ballot must clearly state the full name of the candidate (according to Form No. 08/PLYK attached to this Resolution).

The nominated candidate is the one who receives more than 50% of the votes of the voters present. If multiple candidates receive more than 50% of the votes of the voters present, the nominated candidate will be determined by the voting results, ranked from highest to lowest, until the allocated number is reached. If the voting results are tied, the meeting chairman will compile a list of those candidates for a re-vote, selecting the candidate with the higher vote count, regardless of whether they receive more than 50% of the votes of the voters present. If the re-vote still results in a tie, the meeting will decide whether to proceed with another vote.

g) The vote counting team conducts the vote counting and prepares a vote counting report (according to Form No. 06/BBKP attached to this Resolution). The head of the vote counting team announces the voting results;

h) The conference adopts the minutes of the conference (according to Form No. 04/HNCT attached to this Resolution).

3. In cases of force majeure due to epidemics or natural disasters that prevent the organization of in-person meetings, online meetings or ballots for nominating candidates from villages or residential areas to run for the commune-level People's Council shall be organized. The organization of online meetings or ballot distribution shall be carried out as follows:

The National Election Council decides on organizing online conferences and distributing ballots to voters in their residential areas when the impact of epidemics and natural disasters is nationwide; the Provincial Election Committee decides on organizing online conferences and distributing ballots to voters in their residential areas when the impact of epidemics and natural disasters is within their local area (the entire province, city, or in each commune, ward, village, or residential group).

Based on the decision of the competent authority and the actual conditions and situation in the locality, the Standing Committee of the Vietnam Fatherland Front Committee at the commune level reports to the Party Committee at the same level, discusses and agrees with the People's Committee of the commune and the election-related organizations in the locality to choose the form of organizing online conferences or distributing ballots to collect opinions and organize implementation.

The composition and number of voters invited to attend online conferences or participate in opinion polls must comply with regulations.

The organization of online conferences and the procedure for distributing opinion ballots shall be carried out in accordance with the provisions of points b and c, clause 4, Article 2 of this Resolution.
