The latest regulations on how to calculate overtime pay for teachers during the Lunar New Year holiday.

To ensure security and safety during the Lunar New Year holiday, most schools have decided to assign teachers to take turns on duty during this period.


As of now, most localities have announced the Lunar New Year holiday schedule for 2025 to teachers and students. Depending on their own plans, each locality will have a different number of days off. Some places will have 9 or 10 days off for students and teachers, while others may have up to 17 days.

Of these, Lam Dong and Hanoi are the two localities with the fewest Lunar New Year holidays for students and teachers nationwide so far, with 9 days. The locality with the longest holiday is Kon Tum with 17 days, lasting from January 24th to February 9th (i.e., the 25th of the 12th lunar month to the 12th of the 1st lunar month).

According to regulations from the Departments of Education and Training, schools assign teachers and staff to take turns on duty at the school during the Lunar New Year holiday. Many teachers and school staff members wonder if they will receive overtime pay and how their pay will be calculated if they participate in the 2024 Lunar New Year duty shift.

According to Article 13 of the Law on Public Employees, teachers on Tet holiday will receive their full salary; there is no regulation requiring teachers to be on duty during the Tet holiday. If a teacher is on duty for 5 days during Tet, they will be paid overtime.

Teachers assigned to duty during Tet that do not fall within the 5-day Tet holiday period will only be considered to be on administrative duty and will not receive overtime pay as they would for the 5-day Tet holiday.

Article 98 of the Labor Code stipulates the following regarding overtime and night work wages: Employees working overtime on public holidays, Tet holidays, and paid days off shall be paid at least 300% of their regular wage, in addition to their regular holiday pay, for employees who are paid on a daily basis.

Overtime pay for staff and teachers is calculated using the following formula: Coefficient (salary + position allowance, teaching allowance, seniority allowance) x Base salary (2,340,000 VND) : Daily rate (22 days/8 hours) = Hourly wage. Overtime pay x 300% (overtime pay).

For example, if the total salary of staff and teachers is between 13 million and 19 million VND/month, then the overtime pay for working during Tet (8 hours) each day would be around 1.7 to 2.6 million VND (overtime pay only).

In addition, workers who work at night are entitled to at least 30% more pay based on the hourly wage rate or the actual wage paid for the work performed during a normal workday.

Workers who work overtime at night, in addition to their regular wages, are entitled to an extra 20% of their daytime wage or salary for the work performed during public holidays.
