A series of land regulations will be adjusted to suit the two-tier government model.

The Ministry of Agriculture and Environment is drafting a Decree regulating the decentralization of authority in the land sector, which will adjust a series of land regulations in accordance with the two-level government model.

Mr. Dao Trung Chinh - Director of the Department of Land Management ( Ministry of Agriculture and Environment ) said that the Ministry of Agriculture and Environment is drafting a Decree regulating the decentralization of authority in the land sector when the government organization structure follows a two-level model.

“We will have to adjust many land regulations in the draft new Decree, focusing on handling the contents of decentralization and division of authority in the Land Law associated with the two-level local government organization model; at the same time, amend and supplement a number of articles of the Decrees detailing the implementation of the current Land Law,” Mr. Dao Trung Chinh shared.

According to the Director of the Department of Land Management, a series of Government Decrees will be reviewed and amended, such as: Decree on land prices; on compensation, support, and resettlement when the State recovers land; on basic land surveys; registration, issuance of Certificates of land use rights, ownership of assets attached to land and the Land Information System; detailed regulations on the implementation of a number of articles of the Land Law; and detailed regulations on rice-growing land.

The draft Decree also clearly stipulates the decentralization of authority: People's Councils, People's Committees, Chairmen of People's Committees at the commune level, and agencies with the function of managing land at the commune level will assume some authority previously belonging to the district level. Particularly for land with water surfaces such as ponds, lakes, and lagoons located in many communes and wards, the management authority will belong to the People's Committee at the provincial level according to the provisions of Article 188.

Transfer some land management authority from district level to commune level

Regarding this issue, Minister of Agriculture and Environment Do Duc Duy said that this unit is also studying the organizational model of the Land Fund Development Center and the Land Registration Office; regulations on planning and land use plans at the commune level to replace district-level planning and annual district-level land use plans. In addition, regulations related to land allocation, land lease, and change of land use purposes; and at the same time, it is proposed to supplement transitional regulations in planning, land use plans, compensation, support, and resettlement when the State reclaims land. The review, replacement, abolition, and amendment of phrases in the entire Decree are also set out to ensure consistency with the two-level local government organization model.

The Minister of Agriculture and Environment said that the process of drafting the Decree regulating the decentralization of authority in the land sector is very important in terms of both institutions and practical state management in the land sector, especially in the context of the organization of local government according to the two-level model being implemented.

"This helps to promptly adjust and specify the Land Law in the context of a two-level government organization to ensure consistency, unity and feasibility in law enforcement. At the same time, it resolves problems in practical administration and promotes decentralization and clearer delegation of authority, helping to reduce the burden on the provincial level, while increasing autonomy and flexibility for localities in land management. It is necessary to unify the transfer of some authority from the district level to the commune level, except for some cases such as inter-commune boundaries and land prices. It is necessary to add forestry and agriculture to the scope of regulation. In particular, integrating land and forestry procedures, and at the same time further studying the intersection of legal policies between land allocation and forest allocation, and regulations on forest tree compensation. These contents require specialized agencies to consult with localities before finalizing the draft and submitting it to the Government. It is recommended to review and issue regulations to shorten the time for implementing procedures according to the Government's direction (about 30%). In particular, resolving procedures "Administrative reform is not dependent on administrative boundaries to improve the quality of service for people and businesses," Minister Do Duc Duy emphasized.
