On the afternoon of July 31, in Hanoi, the Ministry of Justice held a seminar on "Law on Dissemination and Education of Law in 2012 and issues that need to be amended and supplemented to meet the requirements of the new situation".
It is necessary to amend and supplement the Law on Dissemination and Education of Law.
In his opening remarks, Deputy Minister of Justice Nguyen Thanh Ngoc emphasized that Resolution 66-NQ/TW dated April 30, 2025 of the Politburo is an important Resolution in promoting institutional improvement, including the task of promoting and improving the quality of legal education and dissemination in the new situation.
Over the past 12 years, the dissemination of legal education has had positive changes in many aspects. However, according to the Deputy Minister, facing the need for innovation, especially in the context of digital transformation and promoting the completion of legal institutions, this work requires innovation in terms of thinking, content, and methods, so that the law reaches all subjects; thereby raising people's legal awareness and forming a culture of law compliance.
In the report, Mr. Phan Hong Nguyen, Deputy Director of the Department of Dissemination, Legal Education and Legal Aid (Ministry of Justice) stated: After more than 12 years of implementing the Law on Dissemination and Legal Education, up to now, the institutions and policies serving the implementation of the Law on Dissemination and Legal Education have been basically built in a complete and synchronous manner, creating a legal basis for the work of disseminating and educating the law to be implemented regularly and stably, contributing to ensuring the right to legal information, forming the habit of proactive learning, raising the awareness of self-compliance and compliance with the law of officials and people. The quantity and quality of human resources performing the work of disseminating and educating the law have been gradually improved and enhanced, ensuring increasingly better the assigned tasks in management as well as professional activities...
However, the implementation of the Law on Dissemination and Legal Education in practice is still limited, leading to the work of disseminating and educating the law not meeting the requirements of society; the awareness of compliance and observance of the law of officials and people is not high, violations of the law in some areas and in some localities tend to increase, with complicated developments, including violations and crimes caused by moral degradation, unhealthy lifestyles, etc.
These limitations have many causes, including those from institutions, policies, and laws, in which the Law on Dissemination and Education of Law has some shortcomings, problems, and is not suitable to reality and needs to be studied, revised, and supplemented.
In addition, recently, the Party and State leaders, General Secretary To Lam, have requested to continue to innovate the work of disseminating and educating the law, closely linking it with the work of building, enforcing the law, and disseminating and educating the law. Therefore, the Law on Dissemination and Education of the Law also needs to be amended and supplemented to meet the requirements and context of the new situation.
Diversify methods of disseminating legal education to suit the target audience.
At the Seminar, lawyer Nguyen Duy Lam, Chairman of the Vietnam Business Law Association, former Director of the Department of Dissemination and Education of Law (Ministry of Justice) emphasized that, in response to the requirement of continuing to perfect the socialist rule-of-law state, innovating the work of building and enforcing laws to meet the requirements of national development in the new era - the era of national development, the organization of law enforcement must be given more importance; the State and society must pay more attention; the content and form of legal dissemination and education must be selected appropriately, creatively, and have a positive impact on improving the effectiveness of this work.
Referring to the contents that need attention in the process of amendment and supplementation, lawyer Nguyen Duy Lam said that it is necessary to diversify the methods of policy communication, dissemination of legal education; apply digital technology in the dissemination of legal education. Along with that, it is necessary to strengthen multi-dimensional and multi-method coordination in the dissemination of legal education; affirm the core role of the State, the responsibility of the entire political system, the participation of people and businesses.
“The amended and supplemented regulations must meet the requirements of the revolution in streamlining the organizational apparatus; delegating more State management power over legal education dissemination to administrative units below the provincial and centrally-run cities level. Promoting the role of the Vietnam Fatherland Front, social organizations, and socio-professional organizations in the work of legal education dissemination,” the lawyer proposed.
Regarding legal education in educational institutions of the national education system, lawyer Duy Lam proposed to study and add an article or a clause on "building a law-abiding lifestyle for students". The content of this issue includes a number of contents: awareness of educational subjects about the importance of building a law-abiding lifestyle, setting an example of law compliance; improving the effectiveness of disseminating legal education to students; building a team of cadres and lecturers doing legal education work with qualifications, skills, and pedagogical methods; building a cultural environment of law compliance; ...
According to Professor, Dr. Nguyen Minh Doan, Hanoi Law University, in order for legal education and dissemination activities to be carried out smoothly and effectively, it is necessary to determine the content appropriate to the subjects needing dissemination and education, the type and level of dissemination and education.
The content of legal dissemination should not only stop at providing information about the law, but also include the dissemination of policies and guidelines of the Party and State on a specific issue, especially for newly issued policies and legal documents and legal activities of relevant organizations and individuals.
Professor, Dr. Nguyen Minh Doan said that every citizen has the right to be disseminated and educated about the law, but every citizen also has the obligation to study the law, live and work according to the law. Therefore, the Law on Dissemination and Education of Law should stipulate that organizations and individuals when producing, doing business, living... in Vietnam must have the obligation to understand, respect and properly implement the provisions of Vietnamese law. From there, it must be stipulated that dissemination, education and study of the law must be mandatory for organizations and individuals according to the minimum program and content common to all citizens. In addition, those who violate the law in any field must be required to study the law in that field.
The representative of the Ministry of Ethnic Minorities and Religions also proposed focusing on innovating content and diversifying forms of legal education dissemination at grassroots level to ensure flexibility and creativity in connection with situations arising in practice, and replicating effective models suitable for specific subjects and localities.
