Amending the law to reorganize the apparatus and promote the supervisory and critical role of the Vietnam Fatherland Front

Institutionalizing the role, organization and authority of the Fatherland Front in the political system

According to the website of the Vietnam Fatherland Front (VFF), presenting the Report, Politburo member, Secretary of the Party Central Committee, Chairman of the Vietnam Fatherland Front Central Committee Do Van Chien clearly stated that the viewpoint of amending the law is to fully institutionalize the Party's guiding viewpoints, especially the Project on arranging, streamlining and merging the Vietnam Fatherland Front agencies, socio-political organizations, and mass associations assigned by the Party and State at the Central, provincial and communal levels (according to Resolution No. 60-NQ/TW dated April 12, 2025 of the Party Central Committee).

The amendment closely follows and fully concretizes the amended and supplemented provisions of the 2013 Constitution directly related to the Vietnam Fatherland Front and socio-political organizations; focusing on amending and supplementing provisions directly related to the position, role, functions, tasks, rights, responsibilities, organizational structure and activities of the Vietnam Fatherland Front, socio-political organizations, and mass organizations assigned by the Party and State.

Regarding the structure and basic content of the draft Law, Mr. Do Van Chien said that the draft Law consists of 5 articles, of which Article 1 amends and supplements 11/41 articles of the Law on the Vietnam Fatherland Front; Article 2 amends and supplements 9/37 articles of the Law on Trade Unions; Article 3 amends and supplements 02/41 articles of the Law on Youth; Article 4 amends and supplements 31/91 articles of the Law on Grassroots Democracy Implementation and Article 5 Effective date.

Specifically, amend and supplement a number of provisions of the Law on the Vietnam Fatherland Front, including: Provisions on the position, role, principles of organization, operation and organizational structure of the Vietnam Fatherland Front, which affirms that the Vietnam Fatherland Front is a part of the political system of the Socialist Republic of Vietnam"; clearly stipulates that the Vietnam Fatherland Front plays the leading role, socio-political organizations coordinate with other member organizations, and at the same time promote the initiative and creativity of each organization in democratic consultation and unified action; stipulates that socio-political organizations and associations assigned by the Party and the State are member organizations under the Vietnam Fatherland Front, organized and operate uniformly within the Vietnam Fatherland Front Committee to ensure the provisions of Articles 9 and 10 of the 2013 Constitution (after amendments and supplements).

The amendments and supplements also mention the regulations on the organization of the Vietnam Fatherland Front at the provincial and commune levels, not at the district level, to synchronize with the arrangement of administrative units and the organization of two-level local governments; regulations on the tasks and powers of the Vietnam Fatherland Front in meeting voters, electing people's defenders, electing people's jurors, in presiding over and unifying with socio-political organizations to carry out social supervision and criticism activities.

Mr. Do Van Chien also said that the amendment and supplementation of a number of provisions of the Trade Union Law focuses on a number of contents: Regulations on the position and tasks of the Trade Union, which affirms that the Trade Union "is a member organization under the Vietnam Fatherland Front", is "a representative of workers at the national level in labor relations and international relations on trade unions" to specify Article 10 of the 2013 Constitution (after amendment and supplementation);

Regulations related to the organization system of the Trade Union to synchronize with the 2-level local government model and adjust the trade union organization in agencies and public service units receiving 100% of their salaries from the state budget to implement the policy of ending the activities of the Vietnam civil servant trade union, trade union organizations mainly in enterprises and industry trade unions, are organized in an open and flexible direction according to the characteristics of the trade union organization;

Regulations on the authority in submitting draft laws, ordinances, resolutions and in the monitoring activities of the Trade Union to be consistent with Clause 1, Article 84 of the 2013 Constitution (after amendments and supplements), consistent with the amended content of the Law on the Vietnam Fatherland Front; regulations related to the subjects of paying trade union fees and the management and use of trade union finances and assets to be consistent with the adjustment of the trade union organization after the reorganization and streamlining.

Along with that, the content of amending and supplementing a number of provisions of the Youth Law affirms that the Ho Chi Minh Communist Youth Union is a member organization under the Vietnam Fatherland Front; the relationship between the Vietnam Fatherland Front and the Youth Union in social supervision and criticism activities must be consistent with the amended content of the Vietnam Fatherland Front Law.

The amendment and supplementation of a number of provisions of the Law on Grassroots Democracy Implementation focuses on a number of contents: Provisions to implement the policy of ending the use of part-time workers at the commune level; provisions related to the organization of two-level local governments and the responsibility of the Ministry of Home Affairs to take over management tasks on implementing democracy in organizations that employ workers when the Ministry of Labor, War Invalids and Social Affairs no longer exists; abolishing provisions on the responsibility of trade union organizations and trade union executive boards at agencies and units without grassroots trade union organizations when implementing the policy of ending the activities of the Vietnam Civil Servants' Trade Union (Resolution No. 60-NQ/TW).

Regarding the effective date, Chairman Do Van Chien said that the Law will take effect from July 1, 2025 and has transitional provisions on the organization and operation of trade unions and trade union executive committees where there are grassroots trade unions in the Law on Implementing Democracy at the Grassroots Level.

Clarifying the "affiliated" nature of member organizations

Presenting the Report on the review of the draft Law, Chairman of the Committee on Culture and Society Nguyen Dac Vinh said that the Committee on Culture and Society agreed with the necessity of promulgating the Law amending and supplementing 4 laws with the political, legal and practical bases stated in Submission No. 29/TTr-MTTQ-DCT dated May 5, 2025 of the Presidium of the Central Committee of the Vietnam Fatherland Front with the scope of amending and supplementing a number of articles directly related to the arrangement of the organizational apparatus; position, role, functions, principles and organization of activities of the Vietnam Fatherland Front, socio-political organizations, mass organizations assigned by the Party and State in the Law on the Vietnam Fatherland Front, the Law on Trade Unions, the Law on Youth, and the Law on Implementing Democracy at the Grassroots Level.

The Committee agrees to develop and promulgate the Law project according to the simplified procedures prescribed in Point b, Clause 1, Article 50 of the Law on Promulgation of Legal Documents. The dossier of the Law project is basically complete according to the provisions in Point b, Clause 5, Article 51 of the Law on Promulgation of Legal Documents.

Basically agreeing with the draft Law amending and supplementing 4 laws, however, the Committee on Culture and Society requested the drafting agency to continue reviewing and supplementing relevant laws in the Review Report of the Law on the Vietnam Fatherland Front; promptly update the amendments and supplements to the Constitution and relevant laws to ensure the constitutionality, consistency, synchronization and feasibility of the legal system. Along with that, the drafting agency needs to clarify the "subordinate" nature of member organizations of the Vietnam Fatherland Front, the working relationship between the Vietnam Fatherland Front and its subordinate members but still ensure relative independence, proactive creativity, operation according to the law and charter of each organization in accordance with the spirit of the Constitution and Resolutions of the Central Committee...
