Creating a legal corridor to promote high-tech development

This amendment to the Law aims to institutionalize Resolution No. 57-NQ/TW of the Politburo on breakthroughs in science and technology development, innovation and national digital transformation, creating a legal corridor to promote high-tech development in accordance with the requirements of socio-economic development and international integration in the new situation.

Continuing the program of the 10th Session of the 15th National Assembly , on the morning of October 31, the National Assembly listened to the Presentation and Verification Report on the draft Law on High Technology (amended).

Encourage businesses to invest in high-tech research and development

Presenting the Report, Minister of Science and Technology Nguyen Manh Hung stated that the development of the Law on High Technology (amended) aims to institutionalize the Party's guidelines and policies and the State's policies on perfecting the legal corridor to promote high technology development in accordance with the requirements of socio-economic development in the 2021-2030 period, with a vision to 2045 and international integration in the new situation; implementing the policy of promoting decentralization and assigning state management authority to local authorities at all levels in promoting high technology development, especially high-tech zones. At the same time, it is necessary to ensure consistency, transparency, feasibility, avoid overlap with the current system of legal documents and remove obstacles and barriers to high technology development today.

The draft Law on High Technology (amended) consists of 6 chapters and 27 articles, reducing 8 articles and changing the structure and form compared to the current Law on High Technology. The scope of regulation is regulations on high technology activities, policies and measures to encourage and promote high technology activities.

The draft Law on High Technology (amended) includes 6 policy groups. Policy 1: Perfecting the concept and criteria of high technology; Policy 2: Redesigning the system of policies and beneficiaries of priority, incentive and investment support policies; Policy 3: Encouraging the development of the high-tech ecosystem; Policy 4: Supplementing regulations on models of high-tech zones and high-tech cities; Policy 5: Supplementing and perfecting regulations on State management of high technology, management, inspection, supervision and efficiency assessment mechanisms; Policy 6: Supplementing regulations on requirements for comprehensive digital transformation of high-tech activities.

The Draft Law is designed according to the principles of simplifying administrative procedures, strengthening post-inspection, and comprehensive digital transformation in high-tech management and operations. Changing management thinking towards effective management, not process management. Attracting non-state budget investment sources for high technology by encouraging enterprises to invest and fund research and development of high technology, strategic technology, high-tech products, and strategic technology products.

Additional research adds provisions for exemption and mitigation of liability when testing encounters risks

Reporting on the review of the draft Law on High Technology (amended), Chairman of the Committee on Science, Technology and Environment Nguyen Thanh Hai said: The Committee basically agrees with the necessity of promulgating the draft Law following a shortened order and procedure. The content of the draft law is basically consistent with the Party's policy, ensuring constitutionality, legality, consistency with the legal system, and compatibility with relevant international treaties.

Regarding specific contents on the State's policies on high-tech and strategic technology development (Article 4), the Committee believes that the draft Law has stipulated many preferential, supportive, attractive and encouraging policies for investment, production and business activities in the high-tech sector. However, it is necessary to clarify more about the guaranteed resources as well as the coordination mechanism between agencies in implementation; it is necessary to stipulate that incentives only apply to high-tech production activities during the time when enterprises meet the prescribed criteria.

For high-tech projects in ethnic minority, border, and island areas,... research and supplement policies on corporate income tax exemption and reduction, support for 0% interest rate loans for investment in digital infrastructure development, and prioritize land allocation for high-tech zones.

Regarding the criteria for determining priority for development investment and strategic technology, the Committee recommends that the drafting agency continue to review and supplement specific quantitative criteria (added value contribution, number of patents, infrastructure standards, human resource qualifications, etc.) to ensure feasibility and fairness. At the same time, supplement the list of high technologies prioritized for development investment, as a basis for determining high-tech products and projects that are encouraged to develop and prioritized in technology transfer activities.

Regarding research and development of high technology and strategic technology, the Committee proposed to study and supplement regulations on incentives and support for research and development of "core technology" and "open technology" (Clause 3, Article 11); to be sponsored and financially supported from the science and technology development fund for high technology research and innovation activities (Clause 4, Clause 6, Article 11).

Regarding support and incentive policies in testing and demonstrating high technology and strategic technology (Clause 3, Article 13), the Committee proposed to study and supplement regulations on exemption and reduction of civil and administrative liability for cases of testing in accordance with procedures but facing risks due to objective reasons; at the same time, clarify priority conditions (such as price priority, technical capacity) to ensure transparency and consistency with the Law on Bidding.
