This amendment and supplement is based on the basis of implementing the policy of applying stricter criminal policies to reduce drug demand and stop the relationship between drug supply and demand. Moreover, the practice of fighting, preventing and combating crimes and violations of drug laws shows that the situation of drug addiction is very complicated, the number of drug addicts is on the rise; drugs are one of the common causes leading to other types of crimes such as theft, fraud, extortion, robbery, etc. People who use drug addiction fall into a state of "stoned", committing particularly serious crimes such as murder, rape, etc. with an increasing tendency.
According to statistics on people with disabilities committing crimes, from January 1, 2018 to May 31, 2025, the rate of crimes committed by people with disabilities accounted for about 10% of the total number of detected crimes; of which, very serious crimes and especially serious crimes accounted for 5.3%. In particular, murder crimes committed by drug addicts and people with disabilities during this period were over 200 cases (of which over 40 cases killed family members)...
Current law also stipulates the handling of the crime of Illegal possession of narcotics and this crime is mainly for those who store them for use. Thus, after a person buys drugs for use, if they are discovered before using them, they will be handled for the act of illegal possession of drugs, but if they are using or have used them, they will not be handled for the corresponding act.
Statistical studies also show that if drug addiction is not well managed to reduce the number of addicts, it will "spread" to others. In practice, the number of people using drug addiction and drug addiction is getting younger, a part of young people are easily enticed and drawn into the path of using drug addiction, turning to drugs to relieve the pressure in life; many people consider drug use as a way to "express themselves"...
Furthermore, the reality of drug addiction treatment shows that many people are in the process of drug addiction treatment or continue to use drugs right after finishing the treatment process, but there are no measures or sanctions to deal with these cases.
It can be said that drug abuse has become a great danger to humanity, causing many very serious consequences, harming the health of a part of the people, and at the same time being the cause of all kinds of crimes, threatening the stability and development of society, the country and the nation. From the above reality, adding the crime of drug abuse is very necessary in the current situation, an effective measure to eradicate drug abuse; in addition to solutions such as cutting off both supply and demand, and propagating to keep people away from drugs.
