The Law on Inspection (amended) has just been passed by the National Assembly with 443/445 delegates present in favor, accounting for 92.68% of the total number of delegates.
The law, which has just been passed by the National Assembly, has supplemented and specified prohibited acts, including acts such as intentionally not issuing an inspection decision when detecting signs of law violations, conducting inspections without proper authority or content; accepting bribes, brokering bribes, taking advantage of positions and powers to harass, cause difficulties, inconvenience, and abuse power; covering up or intentionally letting go of law violations, corruption, waste, and negativity; intentionally drawing false conclusions, and failing to recommend prosecution of cases with signs of crime.
Acts of not providing information or documents or providing them untimely, incompletely, dishonestly, appropriating, destroying, or falsifying documents; disclosing information or documents related to the inspection when the conclusion has not been made public... are also strictly prohibited.
Notably, the inspection period has been significantly shortened. An inspection conducted by the Government Inspectorate shall not exceed 60 days (previously 90 days). An inspection conducted by the Inspectorate of the Ministry of National Defense, the Inspectorate of the Ministry of Public Security , the Inspectorate of the State Bank, and provincial inspectorates shall not exceed 45 days (previously 60 days). An inspection conducted by the Inspectorate of Cryptography and other inspection agencies shall not exceed 30 days.
Regulations on re-inspection have been revised to be more stringent. Signs of law violations for re-inspection are clarified with a re-inspection statute of limitations of 2 years from the date of issuance of the inspection conclusion.
The Government Inspector General and the State Auditor General direct coordination in developing and implementing plans, handling overlaps and duplications; providing, exchanging information and using each other's results.
