Information on the progress of the investigation of the Xuyen Viet Oil Company case

Regarding the case of taking advantage of position and power while performing official duties that occurred at the Ministry of Industry and Trade and localities, Colonel Phan Thanh Ba, Deputy Director of the Investigation Security Department, stated: This is a corruption case of a complex nature, wide scope, taking place over a long period of time, involving many ministries, branches, localities and enterprises. Up to now, the Investigation Security Agency of the Ministry of Public Security has prosecuted 08 defendants from the Ministry of Industry and Trade, the Electricity Regulatory Authority of the Ministry of Industry and Trade, and the Electricity Trading Company - Vietnam Electricity Group for the crime of "Abusing position and power while performing official duties" under Article 356 of the Penal Code.

Initial investigation results determined that the defendants committed violations in advising the Prime Minister to promulgate regulations on subjects and conditions for enjoying preferential electricity price policies under Decision No. 13/2020/QD-TTg, contrary to Resolution No. 115/NQ-CP and the direction of the Prime Minister; violations in appraising, granting electricity operation licenses and recognizing commercial operation dates for a number of solar power plant projects contrary to the provisions of law and the provisions of the Power Purchase Agreement, causing hundreds of billions of VND in damage to Vietnam Electricity Group.

“In the coming time, the Ministry of Public Security’s Investigation Security Agency will continue to investigate and clarify other aspects of the case to strictly handle them according to the law. This case has been put under the supervision of the Central Steering Committee on Anti-Corruption, which is favorable for directing and investigating the case, ensuring a thorough and objective investigation,” Colonel Phan Thanh Ba affirmed.

Referring to the case that occurred at Xuyen Viet Oil Trading, Transport and Tourism Company Limited and a number of related agencies and organizations, Colonel Phan Thanh Ba, Deputy Director of the Department of Investigation Security, said: Up to now, the Ministry of Public Security's Investigation Security Agency has prosecuted 11 defendants, including 02 defendants for the crime of "Violating regulations on management and use of State assets causing loss and waste"; 02 defendants for the crime of "Lack of responsibility causing serious consequences"; 06 defendants for the crime of "Giving bribes"https://dangcongsan.vn/phap-luat/,"Receiving bribes"; 01 defendant "Taking advantage of position and power to influence others for personal gain".

The investigation results so far have determined that the method and tricks of the crimes of these subjects were to take advantage of the State's assignment to collect money from consumers to set up the Petroleum Stabilization Fund through the sale price of petroleum and to manage and use public assets. These defendants did not deposit money into the Petroleum Stabilization Fund account as prescribed; used fraudulent tricks to make reports on the status of the deduction and use of the Petroleum Stabilization Fund that were not true to reality to appropriate money for personal use, causing loss of state assets.

During the investigation, the Ministry of Public Security's Investigation Security Agency focused on clarifying and freezing accounts and suspending transactions on assets related to the case to facilitate future asset recovery.

Currently, the Ministry of Public Security’s Investigation Security Agency is focusing on clarifying the law violations of the defendants and individuals related to the granting of business licenses for petroleum export and import; tax management of Xuyen Viet Oil Company and other signs of law violations to strictly handle them before the law./.
