Ho Chi Minh City plans to issue red books for real estate bought and sold by hand

The Office of the Ho Chi Minh City People's Committee has issued a Notice of Conclusion by Vice Chairman of the Ho Chi Minh City People's Committee Bui Xuan Cuong at the meeting to listen to reports on records of arbitrary land division, arbitrary change of land use purpose, and transfer of rights by hand.

Regarding the issuance of Certificates of land use rights, house ownership rights and other assets attached to land for individual households, the current land law has provisions on authority, conditions, and implementation procedures.

Recently, the Department of Natural Resources and Environment has directed the City Land Registration Office and districts to implement the work of granting Certificates to individual households and has resolved to grant 1,579,274 Certificates (reaching a rate of 99.19%).

However, this work is currently facing difficulties and obstacles in cases where people arbitrarily divide plots, arbitrarily change land use purposes, and transfer rights by hand, leading to a number of files that have not been resolved and issued Certificates because land laws over many periods have different regulations and require coordination to handle many issues by competent state agencies.

To resolve the above situation and to speed up the progress of granting Land Use Right Certificates, the City People's Committee assigned the Department of Natural Resources and Environment to preside over and coordinate with the People's Committees of districts, towns and Thu Duc City based on the local situation and the Official Dispatch of the Department of Natural Resources and Environment to develop a coordination plan and implement it according to regulations.

It is necessary to classify types of documents, determine implementation time, and build a coordination mechanism between agencies and units in handling related issues. Ensure infrastructure and planning conditions, and prevent subdivision, separation, and illegal construction.

For the group of files that have not been received, the Department of Natural Resources and Environment, People's Committees of districts and Thu Duc city will systematize the conditions for being granted a Certificate, have a plan to widely publicize information and propagate, request people to comply with regulations; check and handle violations (if any).
