Accordingly, when there is no longer a Department of Education and Training, the People's Committee at the commune level will perform the function of state management of education for kindergartens, primary schools, and secondary schools; the Department of Education and Training will advise the Provincial People's Committee to perform the function of state management of education for the remaining educational institutions.

In particular, the Ho Chi Minh City Department of Education and Training proposed to directly recruit, use, and appoint teachers and managers; at the same time, it will manage the professional and educational aspects of schools.

Specifically, the People's Committee at the commune level will directly manage the organization and personnel of the community learning center (directing the implementation of the use, evaluation, training, fostering and implementation of policies for the team of the community learning center under the management scope according to regulations); Directing the recruitment of preschool teachers according to the number of employees approved by the competent authority;

Decide on the number of labor contracts for job positions in educational institutions under management; ensure sufficient number of employees to implement educational programs according to regulations; Direct and guide the implementation according to the decentralization of work, management, and implementation of policies to develop the team of teachers, educational institution managers, civil servants, and workers under management authority.

Meanwhile, the Department of Education and Training of Ho Chi Minh City will advise and submit to competent authorities to decide on job positions and civil servant staff of educational management agencies in the province; Advise and submit to competent authorities to decide on job positions and total number of employees in public educational institutions under the management of the province;

Preside over or delegate the implementation of recruitment, use, appointment, change of professional titles, training, fostering, and evaluation of teachers, educational managers, and staff in public educational institutions according to authority; Preside over the implementation of training and fostering for teachers and managers of non-public educational institutions in the province according to regulations.

In addition, the Ho Chi Minh City Department of Education and Training must ensure sufficient staffing for education management, sufficient number of employees working according to the approved job position project, meet the conditions for ensuring education quality, be accountable for education activities, education quality, manage the team of civil servants, public employees, workers and learners, and implement education development policies within the scope of management.

The Department of Education and Training will appoint principals and vice principals of schools.

Also according to the above plan, the Department of Education and Training of Ho Chi Minh City is the agency that makes decisions on recognition, appointment, dismissal, transfer, change of job position, reward, and discipline for heads and deputy heads of public educational institutions;

Guide and organize the implementation of recruitment, use, evaluation, training, fostering, and policy implementation for civil servants, public employees, and workers at educational institutions managed by provincial People's Committees.

In addition, the Ho Chi Minh City Department of Education and Training will take the lead in advising the provincial People's Committee to issue projects, development plans and specific policies for teachers, managers, civil servants and workers in public educational institutions.
