On the morning of November 24, the National Assembly Standing Committee gave opinions on explaining, accepting and revising the draft Law on Construction (amended).

Receiving explanations on construction permits and construction order management, Deputy Minister of Construction Bui Xuan Dung said that some opinions said that the regulation on expanding the subjects exempted from construction permits creates favorable conditions for investors, but it is necessary to strengthen post-inspection work, pay attention to inspection, examination and handling of violations.

There is a proposal that if the project has a complete detailed plan at a scale of 1/500, a construction permit is exempt.

There are also opinions that the exemption from construction permits should not be expanded, because of difficulties in determining property ownership on land; safety is not controlled...

Regarding this, the Government clearly stated the principle that "from preparation to construction commencement, each project only has to carry out one administrative procedure".

This regulation on license exemption includes projects with detailed planning 1/500, in accordance with planning and safety; only small-scale projects (not subject to appraisal) must carry out construction permit procedures.

The draft law simplifies administrative procedures in the direction that licensing procedures will be regulated to be maximally simplified in the decree in the direction of implementing the entire process online; simplifying documents and conditions.

The Deputy Minister of Construction said that the time for granting permits will be reduced to a minimum (expected to be 7-10 days maximum). These regulations will reduce at least 30% of time and costs as required by the Government.

Presenting his opinion on the review, Chairman of the Committee on Science, Technology and Environment Nguyen Thanh Hai said that the expansion of cases exempting from construction permits and home ownership rights has received much attention from delegates.

According to the Land Law, the application for a certificate of ownership of a house requires a house construction permit.

"If the permit is exempted, is it necessary to have a notice of commencement of construction or a design appraisal document with the same value as a construction permit when carrying out procedures for granting ownership certificates to ensure the rights of the people?", Ms. Hai asked and said she was "very worried about this".

She said that the exemption of permits is good enough, but she suggested that the exemption of construction permits must be closely coordinated with the Land Law. Exemption of construction permits and issuance of red books are closely related to each other and involve the people, so they need to be carefully considered.

The Chairwoman of the Committee on Science, Technology and Environment said that there are still about 3,000 real estate projects stuck. She asked the drafting agency to carefully review the transitional regulations to free up resources.

"By removing many provisions and assigning the Government to regulate in detail, it is necessary to commit to the progress and quality of developing the sub-law decree. If the decree is issued late, it will create a legal gap," Ms. Hai noted.

Decentralization and delegation of authority must go hand in hand with capacity.

Regarding construction quality management, the Deputy Minister of Construction said that it is necessary to supplement strong enough regulations for poor quality constructions, clearly defining the roles and responsibilities of relevant parties, such as investors, construction units, and supervisory organizations after the Lo River bridge incident.

The inspection agency proposed to study and supplement regulations on principles for the installation of mandatory monitoring equipment and periodic quality inspection for important works, works with high community significance, and works with safety risks.

Regarding this, the Government said that the draft law stipulates that construction works belonging to important national projects; large-scale works with complex techniques; works that greatly affect safety and community interests must be inspected for acceptance until completion and put into operation.

In response to comments, the drafting agency has revised and supplemented the provisions of the draft law, requiring investors to install monitoring equipment at the construction site (with connection to the management agency) to serve the access, monitoring and supervision of state management agencies and the community on construction quality, promptly detecting and handling violations during the construction process.

The issue of decentralization and delegation of authority must go hand in hand with capacity. From the survey at Lo River Bridge, Ms. Hai stated that the current draft law gives the right to self-acceptance to the investor; the inspection and acceptance are also given and delegated to the locality. For group B and group C projects, it will be given to the commune.

"Is such assignment guaranteed?", Ms. Hai asked and suggested decentralization and delegation of authority to reduce administrative procedures but must ensure that it goes hand in hand with the capacity of commune-level officials.

Regarding incident handling, the Standing Committee found it necessary to review regulations on construction incidents and operation suspension to build a more flexible mechanism.

Specifically, creating conditions for the project to be able to continue components or restart early or what process must be in place for reasonable assessment.

For example, when the Lo River bridge stops working, students have to go 30km in a detour to go to school, and vehicles have to go around a lot.

"If we have to wait for the usual procedures to fix the problem for a long time, we should consider a shortened procedure," Ms. Hai suggested.
