Is it illegal to convert a car into a passenger vehicle?

According to Article 3 of National Technical Regulation QCVN 41:2019/BGTVT on road signs, a passenger car is a type of vehicle identified according to the certificate of technical safety inspection and environmental protection of road motor vehicles to carry more than 9 people.

Clause 1, Article 55 of the 2008 Law on Road Traffic stipulates regulations on ensuring technical safety and environmental protection quality of motor vehicles:

Article 55. Ensuring regulations on technical safety quality and environmental protection of motor vehicles participating in road traffic

1. The production, assembly, modification, repair, maintenance and import of motor vehicles for road traffic must comply with regulations on technical safety quality and environmental protection. Other cars must not be converted into passenger cars.

2. Vehicle owners are not allowed to change the structure, components, or systems of the vehicle that are not in accordance with the manufacturer's design or the modification design approved by the competent authority.

Point b Clause 9; Point b Clause 14 Article 30 of Decree 100/2019/ND-CP stipulates the penalty for the act of arbitrarily converting an internal vehicle into a passenger vehicle:

“Article 30. Penalties for vehicle owners violating regulations related to road traffic

9. Fines from VND 6,000,000 to VND 8,000,000 for individuals, from VND 12,000,000 to VND 16,000,000 for organizations that are owners of cars, tractors, specialized motorbikes and vehicles similar to cars that commit one of the following violations:

b) Converting other cars into passenger cars;

4. In addition to being fined, individuals and organizations committing violations shall also be subject to the following additional penalties:

b) Committing the act specified in Point b Clause 9 of this Article shall have the vehicle confiscated;”

Based on the above regulations, the conversion of other cars into passenger cars is subject to a fine of 6-8 million VND for individuals and 12-16 million VND for organizations that own the cars. In addition, the converted cars will be confiscated according to the law.
