According to the Trial Council, Nguyen Thai Luyen (Chairman of the Board of Directors and CEO of Alibaba Real Estate Joint Stock Company) established 22 companies under Alibaba, assigned Luyen's family members or confidants to be the legal representatives of the companies, and then organized the purchase of large quantities of agricultural land.
The source of money to buy agricultural land was mobilized from customers by using the legal entity of Alibaba Company and companies in the same system, independently establishing 58 residential projects, illegally dividing plots, providing false information such as these were projects with full legal status, self-naming the projects to call for, deceiving customers into signing contracts to sell land plots as residential land to raise money from customers.
At the first instance trial, the People's Court of Ho Chi Minh City sentenced Nguyen Thai Luyen to life in prison, Vo Thi Thanh Mai (defendant Luyen's wife) to 30 years in prison, Nguyen Thai Luc (Luyen's younger brother) to 27 years in prison... After the first instance verdict, Nguyen Thai Luyen, Nguyen Thai Linh, Nguyen Thai Luc, Vo Thi Thanh Mai, Truong Thi Hong Ngoc, Bui Minh Duc, Tran Huy Phuc, Nguyen Quang Son, Vu Hoang Hai, Nguyen Thi Van Anh, Trinh Minh Phap, Trang Chi Linh, Huynh Thi Ngoc Nhu, Nguyen Le Hoang Lan, Vo Van Tran Quang, Phan Ngoc Nguyen, Nguyen Huynh Tu Trinh and Vi Thi Hien, filed an appeal for a reduced sentence. Later, 3 defendants withdrew their appeals: Vi Thi Hien, Nguyen Huynh Tu Trinh and Trinh Minh Phap.
According to the Appellate Court, during the appeal trial, defendant Luyen paid 200 million VND in compensation. However, the crime and consequences that Luyen caused were particularly serious, the amount of compensation paid was insignificant, so the penalty should be maintained. Defendant Vo Thi Thanh Mai realized her wrongdoing and partially remedied the consequences, so the court considered the lowest level of the penalty range.
The remaining defendants have paid compensation of 10-20 million VND, so they are entitled to additional mitigating circumstances. For defendants Huynh Tu Trinh, Nguyen Tran Phuc Nguyen, Dao Thi Thanh Loi, Vi Thi Hien, Nguyen Van Kien, Nguyen Trung Truong, although they did not appeal, to ensure fairness, it is necessary to consider reducing the sentences for these defendants.
Based on the above findings, the Trial Panel did not accept Nguyen Thai Luyen's appeal and upheld the life sentence for "fraudulent appropriation of property". The Appeal Panel sentenced the defendant Vo Thi Thanh Mai to 16 years in prison for fraud and appropriation of property and 7 years in prison for money laundering. The total sentence was 23 years, so the defendant Mai's total sentence was reduced by 9 years compared to the first instance sentence. The remaining defendants and the three defendants who did not appeal were all reduced by 1-2 years in prison by the appellate court.
Regarding civil liability, the Court required Nguyen Thai Luyen and Vo Thi Thanh Mai to jointly compensate nearly 2,500 billion VND to more than 4,500 victims.
