Continuing the 9th session, on the morning of May 8, the National Assembly listened to Mr. Le Quang Huy, Chairman of the Committee on Science, Technology and Environment, report on the reception and revision of the draft Law on Chemicals (amended).
Chairman Le Quang Huy said that, taking into account the comments of National Assembly deputies, the draft Law has a number of provisions to institutionalize the content of "Developing and implementing a roadmap to ban the use of toxic chemicals that pollute water sources" in Conclusion No. 36-KL/TW dated June 23, 2022 of the Politburo on ensuring water source security and safety of dams and reservoirs by 2030, with a vision to 2045.
The draft law also has provisions to promote green transformation, circular economy, and equitable energy transition, thereby applying the principle of “green chemistry” in the design and selection of technology and equipment. Also aiming at green growth and circular economy, the draft law stipulates key chemical industry sectors including basic chemicals, petrochemical products, pharmaceuticals, fertilizers, investment projects in specialized chemical industrial parks, chemical complexes, etc. to enhance the effectiveness of state management.
According to Mr. Le Quang Huy, the draft law submitted to the National Assembly this time has promoted the application of information technology and digital transformation, accordingly, the entire reporting regime and regulations on information disclosure of related organizations and individuals will be implemented on the basis of specialized chemical databases, forming a large database on chemicals to serve state management work.
In addition, administrative procedures such as granting licenses, certificates, chemical consulting certificates, and chemical declaration are performed on the online public service system of ministries, branches, or the national single-window information portal.

The draft law also decentralizes the authority to localities to issue certificates of eligibility for conditional chemical production and trading; certificates of eligibility for chemical storage services; appraisal of chemical incident prevention and response plans according to Government regulations... The above regulations have been developed in accordance with the orientation of implementing the policy of abolishing district-level administrative units.
Regarding the content that many National Assembly deputies were interested in giving their opinions at the previous session, which was the prevention of chemical incidents and the impact of chemicals on the environment, the draft law devoted Chapter VI to chemical safety, which clearly stipulates that chemical production and storage facilities must comply with regulations on material and technical conditions to ensure safety in chemical activities; regulations on plans and measures to prevent and respond to chemical incidents, meet regulations on safe distances, and chemical safety training.
At the same time, Chapter VII of the draft law clearly stipulates the responsibilities of organizations and individuals involved in chemical activities responsible for protecting the environment and community safety.
Notably, the draft law has expanded the scope of regulation for chemical activities, including the subjects of small-scale chemical import, production, trading, and use, and chemical use activities in traditional handicrafts, as well as registration and management of new chemicals.
For propellant and explosive products, these subjects are subject to the Law on Management and Use of Weapons, Explosives and Supporting Tools. Explosive precursors, depending on the level of safety and security risks, will be considered for inclusion in the corresponding management lists according to the provisions of this law, consistent with the Law on Management and Use of Weapons, Explosives and Supporting Tools.
