The land of Mrs. Duong Thi Thanh Mai's family ( Hanoi ) is located in the detailed planning of Bac Co Nhue - Chem 1/500 approved by competent authorities, the land plot is suitable for residential land planning. Mrs. Mai asked, is her family's land plot exempt from a permit to build a single-family house under 7 floors?
The Ministry of Construction responded to this issue as follows:
According to current regulations at Point h, Clause 2, Article 89 of the 2014 Law on Construction (amended and supplemented according to the provisions at Clause 30, Article 1 of Law No. 62/2020/QH14 amending and supplementing a number of articles of the Law on Construction), amended and supplemented at Point c, Clause 1, Article 56 of the 2025 Law on Railways, works are exempted from construction permits:
"The construction project's construction investment feasibility study report has been appraised by a specialized construction agency in an area with a detailed 1/500 scale plan or urban design approved by a competent authority."
Therefore, in the case of individual houses belonging to urban area construction investment projects, housing construction investment projects with detailed planning 1/500 approved by competent state agencies and having their construction investment feasibility study reports appraised by specialized construction agencies, they are exempt from construction permits according to regulations.
In the case of individual houses mentioned by Ms. Mai, if they are not subject to exemption from construction permits as mentioned above, they must have a construction permit according to the provisions of Clause 1, Article 89 of the 2014 Construction Law, amended in Clause 30, Article 1 of Law No. 62/2020/QH14.
