Ministry of Construction sets prices for services in the aviation sector

Presenting the Draft Law on amending and supplementing a number of articles of the Law on Prices, Minister of Finance Nguyen Van Thang said that the draft Law consists of 2 Articles.

The draft amended Law stipulates the transfer of responsibility for implementing price stabilization from the District People's Committee (as assigned by the Provincial People's Committee) to the Commune People's Committee to comply with the 2-level local government model, ending the operation of the District People's Committee from July 1, 2025.

At the same time, amend the names of some goods and services whose prices are determined by the State and the authority and form of pricing in Appendix 2 to comply with the provisions of some newly amended and supplemented specialized laws as well as on the basis of overcoming difficulties of some localities and ministries and branches in the process of implementing State pricing work; amend the names of services in the aviation sector under the pricing authority of the Ministry of Construction to ensure consistency with the draft Law replacing the Law on Civil Aviation of Vietnam, which will also be passed by the National Assembly at the 10th Session.

Minister Nguyen Van Thang also said that the draft Law amends the name of the group of vehicle inspection services under the pricing authority of the Ministry of Construction in the direction of removing from the list types of services that are not essential services, highly socialized with the participation of private inspection organizations or foreign inspection organizations allowed to participate in providing services in Vietnam.

In addition, amend the authority to determine the price of technical inspection services for machinery, equipment, materials and substances with strict requirements on labor safety set by the Ministry of Labor - Invalids and Social Affairs (formerly) and the authority to determine the price of technical inspection services for machinery, equipment, materials and substances with strict requirements on safety specific to industrial sectors set by the Ministry of Industry and Trade to the Ministries and branches according to the scope of management of the sector and field prescribed in the law on labor safety and hygiene to set the price to synchronize with the authority to grant, extend and revoke the Certificate of eligibility for labor safety inspection of 6 Ministries (after rearranging the organizational apparatus) in Decree No. 44/2016/ND-CP.

Ensure flexibility, initiative, and suitability to reality

Examining this content, Chairman of the Economic and Financial Committee Phan Van Mai stated that Clause 1, Article 1 of the draft Law amending Article 1 of the Law on Prices (scope of adjustment) is to adjust the phrase "specialized price inspection" to "inspection in the field of prices", and at the same time adjust accordingly in related articles and clauses.

The majority of opinions in the Economic and Financial Committee agreed with the draft Law to ensure compliance with the Party's policy on streamlining the inspection agency system to be lean, strong, efficient, effective, and efficient. There were opinions suggesting that the content of inspection in the field of prices should not be regulated in the Law on Prices.

Regarding the list of goods and services priced by the State, the Economic and Financial Committee basically agrees with the provisions in Point a, Clause 4, Article 1 of the draft Law to ensure consistency with relevant legal provisions and in line with the policy of promoting decentralization and delegation of power. However, it is recommended that the drafting agency continue to review and ensure consistency with the Law on Civil Aviation (amended) to avoid difficulties in implementation.

The Chairman of the Economic and Financial Committee said that the majority of opinions in the Committee basically agreed with the draft Law, which assigns the authority to determine prices to the People's Committees at the provincial level to determine specific prices to reduce administrative procedures, ensuring consistency and unity in the management and exploitation of investment assets from state budget capital sources.

Some opinions suggested considering the regulation that the Provincial People's Committee prescribes the price framework and the agency assigned to manage infrastructure in industrial parks, economic zones, concentrated digital technology zones, high-tech zones and industrial clusters decides on specific prices to ensure flexibility, proactiveness, suitability to reality and still ensure the management of State service prices.
