After more than two weeks of work, on the morning of October 4, the People's Procuracy proposed a penalty for defendant Truong My Lan (former Chairwoman of the Board of Directors of Van Thinh Phat Group) and 33 accomplices.

In the case under trial, Ms. Lan and 33 accomplices were accused of the crimes of Fraudulent appropriation of assets (VND 30,000 billion of 35,824 bondholders), Money laundering (VND 445,768 billion) and Illegal transportation of currency across the border (USD 4.5 billion). The People's Procuracy: Particularly dangerous behavior According to the People's Procuracy, since 2018, defendant Truong My Lan has met with key leaders of SCB Bank and Tan Viet Securities to issue bonds of 4 companies. By fraudulent means, Ms. Lan and her accomplices sold bonds to nearly 36,000 victims, appropriating more than VND 30,000 billion and using them for purposes other than the issuance. The representative of the prosecution agency determined that Ms. Truong My Lan was the person who controlled and operated all activities of Van Thinh Phat. During the interrogation, defendant Lan claimed that she did not propose the policy of issuing bonds, but the Procuracy determined that this statement was baseless. In addition, the Procuracy accused Ms. Lan of directly directing her subordinates to commit many violations.

The defendants' actions are particularly dangerous to society, occurring over a long period of time, continuously, and this defendant's actions are the premise for other defendants to commit crimes. In particular, defendant Truong Khanh Hoang (acting General Director of SCB) is the person who received the policy from Ms. Lan, directed subordinates to run "fake" money flows, and issued bonds in violation of the law. Ms. Ngo Thanh Nha (Ms. Lan's sister-in-law) was accused by the People's Procuracy of signing a contract for An Dong Company to issue bonds worth nearly 25,000 billion VND in violation of the law. Regarding the remaining defendants, the People's Procuracy determined that they had helped Ms. Truong My Lan to defraud and appropriate property. Regarding the crime of Money Laundering, the representative of the People's Procuracy said that, in order to conceal the origin of the money and legalize the amount of more than 415,000 billion VND "stolen" from SCB, Ms. Truong My Lan directed her subordinates to carry out many "money laundering" tricks. The investigation results determined that the amount of 415,000 billion VND "stolen" from SCB was withdrawn and transferred through hundreds of personal and legal entity accounts for use under Ms. Lan's direction. According to the People's Procuracy, Ms. Truong My Lan played the main role in the crime of Money Laundering and other defendants played the role of accomplices. One of the accomplices who helped Ms. Lan launder money was Mr. Chu Lap Co (defendant Lan's husband). Accordingly, this defendant used 33 billion VND of criminal origin. Regarding the crime of Illegally transporting currency across the border, the People's Procuracy determined that Ms. Lan and her accomplices transferred 1.5 million USD abroad and received 3 million USD from abroad to Vietnam. According to the People's Procuracy, the indictment against Truong My Lan and her accomplices and accomplices was the right person, the right crime, and not a wrongful conviction. Mr. Chu Lap Co was proposed to be sentenced to 24-30 months in prison. Ms. Lan and many accomplices were applied with aggravating circumstances of committing the crime 2 times or more, using sophisticated tricks. In addition, the Procuracy recognized the mitigating circumstances of the owner of Van Thinh Phat, such as her honest confession and many contributions to society... According to the prosecution, the defendant Truong My Lan is over 60 years old and agreed to use all her assets to remedy the consequences, but in this case, the consequences are particularly large, seriously affecting social order, so a corresponding sentence is needed. From the above analysis, the Procuracy proposed that the panel of judges sentence the defendant Truong My Lan to life in prison for the crime of Fraudulent appropriation of property, 12-13 years in prison for the crime of Money Laundering, and 8-9 years in prison for the crime of Illegally transporting currency across the border. The total sentence proposed for her is life in prison. In phase 1, the owner of Van Thinh Phat was sentenced to death for the crime of Embezzlement of property and is awaiting appeal. In relation to the case, the defendant Truong Hue Van (Ms. Lan's niece) was proposed to be sentenced to 6-7 years in prison; Ngo Thanh Nha was sentenced to 7-8 years in prison for fraud and appropriation of property. Mr. Chu Lap Co was recommended to be sentenced to 24-30 months in prison for money laundering. The remaining defendants were recommended to be sentenced to between 30 months and 27 years in prison. Regarding civil matters, the People's Procuracy requested the panel of judges to hold defendant Truong My Lan responsible for compensating all damages in the case. At the same time, continue to seize real estate and assets related to Ms. Lan to remedy the consequences. During the interrogation process in court, all defendants who assisted Truong My Lan admitted to committing the crime as stated in the indictment. At the same time, these people further stated that they were only employees, did not benefit, and had repented, so they asked the panel of judges to consider reducing their sentences. Defendant Truong My Lan stated that she did not propose the policy of issuing bonds and did not intend to defraud and appropriate property. At the same time, this defendant proposed solutions to remedy the consequences for bondholders.

Presenting to the court a plan to remedy the consequences for bondholders, Ms. Lan said that in addition to the 21,000 billion VND recovered in phase one, during the investigation of phase two, her family and Van Thinh Phat Group had paid more than 386 billion VND. She continued to request the court to recover more than 17,000 billion VND that some banks had benefited from the bond issuance money. At the same time, she said she would use the 6A project in Binh Chanh district worth more than 20,000 billion VND, the Amigo project in District 1 worth 3 times more than Times Square and a series of assets that are being seized, blocked and prevented to remedy the consequences. The case file shows that Ms. Truong My Lan had 2 albino Hermès bags confiscated by the Ministry of Public Security's Investigation Agency. At the court, the owner of Van Thinh Phat said she wanted to get the 2 bags back as souvenirs for her children and grandchildren.
