According to the Ministry of Construction , currently, the assignment of investors to propose the preparation of a pre-feasibility study report for the project to upgrade and expand the road in operation under the PPP method has been permitted by the law on PPP and the law on roads. In addition, the conditions, order and procedures for projects proposed by investors have been stipulated in Article 26 of the PPP Investment Law and Articles 26 and 27 of Decree No. 243/2025/ND-CP (dated September 11, 2025) of the Government detailing a number of articles of the PPP Law. At the same time, according to the provisions of the Road Law and Decree No. 165/2024/ND-CP (dated December 26, 2024) of the Government detailing and guiding the implementation of a number of articles of the Road Law and Article 77 of the Law on Road Traffic Order and Safety: Provincial People's Committees are responsible for receiving road infrastructure assets and organizing the management of national highways when decentralized.
The Project to Upgrade and Expand National Highway 51 (Phase 1) under the form of BOT contract is authorized by the Ministry of Transport (now the Ministry of Construction); the investor is the IDICO - DIC - Thai Ninh joint venture; the project enterprise is Bien Hoa - Vung Tau Expressway Development Joint Stock Company, put into operation in 2013, has finished collecting tolls to recover capital. The Ministry of Construction has directed the Vietnam Road Administration (the agency assigned to manage assets) to transfer the road traffic infrastructure assets of this national highway to the People's Committee of Dong Nai province and the People's Committee of Ba Ria - Vung Tau province, now Ho Chi Minh City, for management and exploitation.
Therefore, according to the Ministry of Construction, based on the regulations, the consideration of investment in renovating and upgrading National Highway 51 (phase 2) is under the authority of the road infrastructure asset management agency. The Ministry of Construction has no opinion on the project proposal of the CC1 - BVEC investor consortium because this content is under the authority of the People's Committee of Ho Chi Minh City and the People's Committee of Dong Nai province.
Previously, in October 2025, the CC1 - BVEC consortium proposed to implement the Project to Improve and Upgrade National Highway 51 under the PPP method, BOT contract form. According to the CC1 - BVEC consortium, National Highway 51 (section from Km0+900 to Km73+600) is a vital traffic route connecting Ho Chi Minh City with Dong Nai province. Currently, this route has been severely damaged, the road surface is bumpy, dense with potholes and ruts; many sections of median strips, manhole covers are damaged, and painted lines are blurred, leading to potential risks and accidents for people and vehicles. Therefore, this route needs to be urgently studied for investment, improvement and upgrading plans to improve traffic capacity, reduce congestion and traffic accidents, and at the same time create momentum for socio-economic development of localities through which the route passes.
