The Ministry of Home Affairs develops a termination policy for cadres, civil servants and public employees when streamlining the payroll, including immediate termination and termination after vocational training.
Immediate termination policy for those subject to staff reduction who have not reached retirement age as prescribed in Appendix I and Appendix II issued with Decree No. 135/2020/ND-CP and are not eligible for early retirement policy as prescribed in Article 6 of the Decree on staff reduction.
If cadres, civil servants and public employees quit their jobs immediately, they will be entitled to the following 3 regimes: Receive a subsidy of 3 months of current salary to find a job; Receive a subsidy of 1.5 months of current salary for each year of work with compulsory social insurance; Have the compulsory social insurance payment period reserved or receive a one-time social insurance payment according to the provisions of the law on social insurance.
The policy of severance after vocational training is for those who are under 45 years old, have good health, a sense of responsibility and a sense of organization and discipline but are taking on jobs that are not suitable for their training level and major, and wish to quit their jobs. The agency, organization or unit will create conditions for them to go to vocational training before deciding to quit their jobs and find new jobs.
Officials, civil servants and public employees who quit their jobs are entitled to receive their full current salary and have their agency or unit pay social insurance, health insurance and unemployment insurance (if they are eligible for unemployment insurance) during their vocational training period, but the maximum period of benefit is 6 months; they are subsidized with a vocational training fee equal to the cost of the vocational training course, up to 6 months of their current salary, to pay to the vocational training facility.
After completing the apprenticeship, you will receive a subsidy of 3 months of your current salary at the time of studying to find a job; you will receive a subsidy of 0.5 months of your current salary for each year of work with social insurance.
During the apprenticeship period, continuous working time is counted but seniority is not counted for annual salary increase.
Officials, civil servants and public employees who quit their jobs are allowed to retain their compulsory social insurance payment period or receive one-time social insurance benefits according to the provisions of the law on social insurance./.
