Article 5 of Circular 28/2009/TT-BGDDT (amended and supplemented by Clause 3 and Clause 4, Article 1 of Circular 15/2017/TT-BGDDT) stipulates working hours and annual leave as follows: Teachers' annual leave includes: Summer vacation, Lunar New Year holiday, semester break and other holidays, specifically: Teachers' annual summer vacation is 2 months (including annual leave according to the provisions of the Labor Code), with full salary and allowances (if any); Lunar New Year holiday, semester break according to the provisions of the Minister of Education and Training ; Other holidays according to the provisions of the Labor Code.
Based on the school year plan, scale, characteristics and specific conditions of each school, the principal arranges annual leave time for teachers reasonably in accordance with regulations.
According to the above regulations, teachers are entitled to 2 months of vacation (including annual leave as prescribed by the Labor Code), with full salary and allowances (if any). However, the above regulations only apply to teachers, and do not specify summer vacation time for principals or vice principals (educational institution managers).
Educational institution managers are civil servants and are entitled to annual leave according to the 2010 Law on Civil Servants. Article 13 of this Law stipulates the rights of civil servants to rest as follows: Annual leave, holidays, and personal leave according to the provisions of the law on labor. Due to work requirements, civil servants who do not use or do not use up their annual leave days will be paid a sum of money for the days not taken.
Civil servants working in mountainous, border, island, remote areas or other special cases, if requested, may combine the number of leave days of 2 years to take one leave; if combining the number of leave days of 3 years to take one leave, the consent of the head of the public service unit is required.
For specific career fields, civil servants are entitled to leave and receive pay according to the provisions of law. They are entitled to leave without pay in cases where there is a legitimate reason and with the consent of the head of the public career unit.
Thus, the principal and vice principal will be entitled to annual leave, holidays, and personal leave according to the provisions of labor law like employees.
