
The delegate informed that currently, the defense industry, security industry and industrial mobilization are regulated in the 2008 Defense Industry Ordinance, the 2003 Industrial Mobilization Ordinance, Decree No. 63/2020/ND-CP and other relevant legal documents. Through the implementation process, it is necessary to develop a Law to regulate the regulations on defense industry, security industry and industrial mobilization to ensure consistency and unity in the legal system in order to concretize the Party's policy from the 7th National Party Congress to the 11th, 12th and 13th National Party Congresses on "Building and developing modern, dual-use defense and security industry to both meet the requirements and tasks of protecting the Fatherland and make an important contribution to socio -economic development... ".
Delegate Lo Thi Luyen said that some regulations related to the expenditure content of ministries, ministerial-level agencies, government agencies, provincial People's Committees for industrial mobilization and regulations on regimes and policies for: core defense industrial establishments, security industrial establishments participating in research and production of strategic weapons and technical equipment , special technical means . Regimes and policies for people such as: workers in core defense industrial establishments , security industrial establishments; leading experts, scientists , general engineers in the field of research and production of strategic weapons and technical equipment , special technical means ; workers directly performing industrial mobilization tasks are regulated in the direction of listing specific contents and policies in the draft Law.
According to the delegate, in addition to ensuring the provisions of this Law, these expenditure contents must also meet the conditions prescribed by other laws such as the Law on Public Investment, the Law on State Budget, the Labor Code, the Law on Social Insurance, the Law on Health Insurance, etc. On the other hand, in the process of organizing and implementing the Law in practice, there will be arising contents.
Citing a specific content on the regulation on the State allocating budget and other resources to support funding for kindergartens and education in areas where there are no schools under the public education system; medical funding for places where infirmaries must be maintained due to special conditions; or kindergartens and infirmaries in the area must be maintained according to the decision of the Ministry of National Defense and the Ministry of Public Security . "These contents have been stipulated in the 2008 Defense Industry Ordinance and the 2003 Industrial Mobilization Ordinance , but at that time, the infrastructure in the fields of health and education was still difficult, so the regulation was appropriate. However, up to this point, these contents need to be studied to be suitable to reality" - Delegate Lo Thi Luyen expressed her opinion.
Delegates said that the draft Law should only stipulate principles, while specific policies should be assigned to the Government to ensure flexibility and convenience in the implementation process.
