Regarding the staffing of commune-level cadres, civil servants and public employees, the Project clearly states that the scale of commune-level administrative units after the reorganization will be larger than at present and the tasks and powers of commune-level local authorities will increase (performing all the tasks and powers of current district-level and commune-level local authorities).
Therefore, the Government's immediate orientation is to maintain the current number of district-level cadres, civil servants, and public employees and commune-level cadres and civil servants (before the rearrangement) to be assigned to commune-level administrative units (after the rearrangement). Review and streamline the staffing in conjunction with restructuring and improving the quality of the communal-level cadres, civil servants, and public employees to meet the requirements of the tasks, ensuring that within a period of 5 years, they will basically comply with the regulations.
The Government assigned the Ministry of Home Affairs to coordinate with the Central Organizing Committee and relevant agencies to base on population size, natural area, functions, tasks, and powers of local authorities at the commune level as a basis for developing and perfecting job positions to submit to competent authorities to assign the establishment of commune-level cadres, civil servants, and public employees to localities.
Based on the population size, natural area, and socio -economic development level of commune-level administrative units, the Government directs the allocation of total local government staff at the commune level to localities (expected to be an average of about 32 staff/1 commune level).
On that basis, the Government assigns the provincial-level local authorities to decide on the number of staff for local authorities at each commune-level administrative unit in the area in accordance with practical requirements.
Regarding the regime and policies, the Government allows the preservation of the current salary regime and policies and position allowances (if any) of cadres and civil servants assigned to work at the new commune-level administrative unit after the arrangement for a period of 6 months.
After this period, salary and position allowance policies will be implemented in accordance with new legal regulations.
Also in the Project, the Government decided to end the use of part-time workers at the commune level; assigned local authorities to consider and possibly arrange part-time workers at the commune level who meet the requirements of the task to participate in work in villages and residential groups.
Localities are required to implement a layoff policy for part-time workers at the commune level who do not arrange work according to regulations.
