Da Nang: Fined over 200 million VND for businesses late in paying social insurance

The People's Committee of Da Nang City has just decided to impose an administrative fine of more than 200 million VND on Phuoc Minh Nghia Company Limited for violations in the field of social insurance and health insurance.

Phuoc Minh Nghia Company Limited (headquartered in Mieu Bong Village, Hoa Phuoc Commune, Hoa Vang District, Da Nang City) committed administrative violations in late payment of compulsory social insurance and unemployment insurance of more than 133.2 million VND; did not pay social insurance and unemployment insurance for 83 people who were subject to compulsory social insurance and unemployment insurance (including not paying for 72 employees more than 1 billion VND, and paying late for 11 employees who were still within the statute of limitations for handling administrative violations of more than 89.7 million VND).

In addition, the company also paid insufficient health insurance for the number of people required to participate in employer health insurance for 83 employees (72 people did not pay, 11 people paid for insufficient time).

For the above violations, Phuoc Minh Nghia Company Limited was administratively fined by the People's Committee of Da Nang City with a total amount of VND 200,967,000, including: Fine for late payment of social insurance and unemployment insurance with a total amount of VND 35.9 million; fine for failure to pay social insurance and unemployment insurance for 83 people with a total amount of VND 150 million; fine for failure to pay health insurance for the number of employees required to participate in health insurance by the employer with a total amount of VND 15 million.

At the same time, Phuoc Minh Nghia Company Limited is required to pay the full amount of compulsory social insurance and unemployment insurance to the social insurance agency as determined in Inspection Record No. 08/BB-DTT332 dated September 21, 2023 of the Inspection Team according to Decision 332.

Phuoc Minh Nghia Company Limited shall pay an interest amount equal to 2 times the average social insurance fund investment interest rate of the previous year (0.6984%/month) calculated on the amount and time of late payment; if not, at the request of the Chairman of the People's Committee of Da Nang City, other credit institutions, the State Treasury shall be responsible for deducting from the deposit account of Phuoc Minh Nghia Company Limited to pay the late payment amount and the interest on this amount calculated according to the highest non-term deposit interest rate of state-owned commercial banks announced at the time of penalty (0.3%/year) into the account of the social insurance agency.

The time limit for implementing remedial measures is 10 days from the date of receipt of the decision. All costs for implementing remedial measures shall be paid by Phuoc Minh Nghia Company Limited. Phuoc Minh Nghia Company Limited is responsible for strictly complying with the penalty decision. If after the deadline Phuoc Minh Nghia Company Limited does not voluntarily comply, it will be forced to comply according to the provisions of law.
