National Assembly delegates propose clarifying regulations on ownership of products created by artificial intelligence

On the morning of November 5, the National Assembly discussed and gave opinions on the provisions of the Draft Law on Civil Judgment Enforcement (amended) and the Draft Law on amending and supplementing a number of articles of the Law on Intellectual Property.

Regarding the draft Law amending and supplementing a number of articles of the Law on Intellectual Property, delegates proposed clearly defining the contents about authors and owners of products with artificial intelligence elements.

"I suggest that the drafting agency needs to clarify the regulations on ownership of AI-generated products and the boundary between machine learning exploitation and copyright infringement. Because this is a very important matter. I suggest separating a chapter regulating intellectual property in the digital environment and having specialized instructions on the contents related to AI creating works, who owns the rights, training data processing, sharing and exploitation rights," said Mr. Nguyen Ngoc Son (National Assembly Delegate of Hai Phong City ).

"I propose adding a new provision on works with artificial intelligence elements in the direction of only protecting works with significant human creative direction and control. The person who operates, programs or controls AI content is considered the legal author. Self-generated AI works without human elements should only be recognized as data or non-work initiatives. I think it is necessary to focus on research to legalize this," said Mr. Le Hoang Anh (National Assembly Delegate of Gia Lai province).

Regarding the revised Law on Civil Judgment Enforcement, delegates proposed to perfect regulations to protect the rights of judgment beneficiaries as well as speed up the enforcement process in cases with enforcement conditions.

National Assembly deputies discussed the draft Law amending and supplementing a number of articles of the Law on Intellectual Property.

"When a verdict has been announced, in the name of the state, the verdict is of course effective and must be executed immediately. Why is there a provision in our regulations, which is still being implemented today, that the litigant must file a petition to have the verdict executed? I think it is inconsistent with legal logic and the issue of rights. I propose to remove the provision that citizens must file a petition," Mr. Nguyen Lam Thanh (National Assembly Delegate of Thai Nguyen province) suggested.

"It is proposed to add the responsibilities of the prosecutor's office in a number of provisions of the law to ensure the right to control judicial activities, adding the responsibilities of the prosecutor's office, that is, the results of verifying the conditions for execution of the judgment must be sent to the competent prosecutor's office within 3 working days from the date of verification results, except in cases where this law has other provisions," Mr. Luong Van Hung (National Assembly Delegate of Quang Ngai province) expressed his opinion.

Also this morning, delegates gave their opinions on the draft Law on Judicial Expertise (amended) and the Law on amending and supplementing a number of articles of the Law on Anti-Corruption.
