Assessing the impact of the high-quality educational institution model

Continuing the 7th Session program, on May 28, the National Assembly discussed in the hall a number of contents with different opinions of the draft Law on Organization of People's Courts (amended) and the draft Law on Capital (amended).

Regarding the draft Law on Organization of the People's Court (amended), the issue that many delegates agreed with and commented on at the meeting was the regulation on expanding the source, promoting the implementation of the examination mechanism to appoint judicial positions; adding lawyers, university lecturers... as "sources" to select and appoint as Judges of the Supreme People's Court. Article 96 of the draft Law stipulates very strictly the conditions for appointing Judges of the Supreme People's Court. Notably, Clause 2 of this Article has expanded the source for appointing Judges of the Supreme People's Court. Specifically, people who do not work in the Courts but have high prestige in society, have the capacity to judge and resolve other matters under the jurisdiction of the Supreme People's Court according to the provisions of law can be selected and appointed as Judges of the Supreme People's Court when they fall into one of the following cases: People holding important positions in central agencies and organizations, with deep understanding of politics , law, economics, culture, society, security, national defense, and diplomacy; Experts, lawyers, university lecturers, scientists with high qualifications in law, holding important positions in political agencies, organizations, socio-political organizations, socio-political-professional organizations, and socio-professional organizations. Discussing this issue, delegate Do Ngoc Thinh (Khanh Hoa) said: "Many countries in the world have this content when selecting judges. Because if we can take advantage of this resource, it will help the Court improve the quality of its adjudication activities because they have specialized, professional and experienced qualifications. The Court does not have to train but has high-quality human resources". Discussing the draft Law on the Capital (amended), National Assembly delegates assessed that the draft Law dossier has been prepared very carefully and fully according to the provisions of the Law on Promulgation of Legal Documents; demonstrating the direction of the Central Committee and the Conclusion of the Politburo. That is to strengthen decentralization, delegation of power, have a suitable and effective pilot mechanism for the Capital; focusing on the field of financial investment, attracting non-budgetary resources, having a public-private partnership mechanism on land use planning, organizational structure, creating creativity, proactive spirit, autonomy, and self-responsibility of the Capital.

Concerned about the provisions on building, developing and expanding high-quality educational institutions in Article 22 of the draft Law, delegate Nguyen Thi Tuyet Nga (Quang Binh) pointed out that this is a different provision from the provisions on educational institutions in the education law. This issue has been stated in the appraisal report of the Ministry of Justice and the inspection report of the National Assembly's Law Committee. The draft Law has proposed a model that has not been used in the Education Law, including high-quality educational institutions; the criteria for recognition of high quality have not been clarified.
According to delegate Nguyen Thi Tuyet Nga, in practice, the implementation of the model of high-quality public schools with high tuition fees is a concern for many voters in Hanoi. The model of high-quality educational institutions is being implemented mainly in the form of providing high-quality educational services. The tuition fee ceiling for high-quality public educational institutions in Hanoi for the 2023-2024 school year is from 5 - 6.1 million VND/student/month (excluding other contributions). Currently, many quality public schools are making a project to become high-quality schools. Many parents and students are very worried about high tuition fees while their family conditions are not guaranteed and are confused because they do not know which school to transfer their children to. The delegate suggested that the Government consider further the development of the model of high-quality educational institutions; assess long-term impacts, ensure a fair educational environment, not contrary to common views on education and general principles on public schools. At the same time, Hanoi needs to focus on building exemplary national standard schools, creating a ripple effect for general education nationwide and investing more heavily in building public kindergartens and general schools; meeting the requirement that all children can go to general schools as they wish. The draft Law on the Capital (amended) submitted to the National Assembly at the 7th Session has been accepted and adjusted in the direction of strong decentralization and delegation of power to Hanoi city; helping the city government to be more proactive in organizing the apparatus and staffing to be able to effectively undertake the very special role and task of being the capital of the Socialist Republic of Vietnam. Specifically, decentralizing power to the Hanoi People's Council to decide on the establishment, reorganization, and dissolution of specialized agencies and other administrative organizations under the City People's Committee to ensure the criteria and conditions according to regulations; The City People's Committee is assigned to regulate the adjustment of the structure of civil servants, public employees and job positions in accordance with the organizational structure, functions, tasks and powers of agencies, organizations and units under its management... Regarding the construction, development, management and protection of the Capital, the draft Law is absorbed and revised in the direction of setting higher requirements and responsibilities for Hanoi city compared to other localities to ensure the implementation of the goals and tasks of construction, development, management and protection of the Capital as determined in Resolution No. 15-NQ/TW dated May 5, 2022 of the Politburo on "Orientations and tasks for the development of Hanoi Capital to 2030, with a vision to 2045", clearly defining specific policies that need to be applied, more clearly defining the subjects of application, responsibilities and authorities of agencies, procedures and implementation procedures to both demonstrate strong decentralization to the city government and have a mechanism for implementation and control the execution.
