According to the new regulations on electronic invoices in Decree 123 of the Government and Circular 787 of the Ministry of Finance , businesses will not be allowed to issue invoices with different numbers or backdated dates. Specifically, after entering data and issuing invoices, businesses will sign and send them to the Tax authority to issue codes, then send invoices to buyers.

Thus, at the time of issuing invoices, businesses must immediately send electronic invoices to the tax authorities to ensure that the invoices are legally valid. This is causing difficulties for businesses.

At the workshop, a representative of Masan Group said that in order to comply with the regulation on issuing electronic invoices generated from cash registers, the group's supermarket system may have to issue up to 18 million electronic invoices in a month, and the enterprise must invest in infrastructure and transmission lines at a cost of tens of billions of VND per year. This causes difficulties in the enterprise's business operations.

In the same situation, a representative of Daiichi Life Vietnam Insurance Company expressed that they are facing difficulties in implementing the electronic invoice format as required by the tax department. Accordingly, the enterprise does not receive timely support from the tax authority when changing the electronic invoice format as required by the tax authority.

As a result, businesses have to struggle to do it themselves and encounter many difficulties. Therefore, Daichi proposed that the tax authority update the list of absconding businesses, businesses with illegal electronic invoices and provide early warnings. This is to help businesses avoid having to revise tax declarations multiple times.

Faced with the above difficulties, Mr. Dang Ngoc Minh - Deputy Director General of the General Department of Taxation acknowledged the business's proposal on issuing invoices from cash registers. The tax authority will study and make appropriate amendments to create favorable conditions for businesses.

Mr. Dang Ngoc Minh said that currently there are still "ghost" businesses, so the tax industry has added more cases where electronic invoices are stopped and wants to hear businesses' opinions on this regulation.

There are currently 7 cases of stopping the use of electronic invoices. However, recently there have been a number of fraud cases in the process of using electronic invoices when refunding value added tax.

On that basis, the Deputy General Director of the General Department of Taxation proposed 5 cases of stopping the use of electronic invoices, including: Competent agencies detect and notify tax authorities of signs of enterprises being established to illegally buy, sell and use electronic invoices; Taxpayers are under key tax supervision; Taxpayers show signs of irregularities according to tax risk assessment criteria; Business households paying taxes by declaration method switch to lump-sum method or pay taxes on each occurrence; Taxpayers have a written request to temporarily stop using electronic invoices .
