Draft Resolution of The National Assembly stipulates a number of mechanisms and policies to remove difficulties and obstacles in organizing the implementation of the Land Law, submitted by the Government to the National Assembly Standing Committee, including 3 chapters and 13 articles, focusing on solving many groups of issues, including land recovery, compensation, resettlement support; land allocation and lease; and dispute resolution.


The draft resolution adds three cases where the State reclaims land for socio -economic development in the national and public interest.
Firstly, there are free trade zone projects and projects in international financial centers. These projects use a lot of land, promote local socio-economic development, contribute large revenues to the budget, and create more jobs, but there are no regulations on land recovery, causing difficulties in accessing land and implementing projects.
Second, in case the investor negotiates over 75% of the area or with 75% of the land owners, the Provincial People's Council will reclaim the remaining area to hand over to them.
The third case is the State's recovery to create land fund for payment under BT contract, land lease to continue production and business.

Examining the draft resolution, the National Assembly's Economic and Financial Committee said that the Standing Committee of the Committee believes that reviewing land reclamation cases to suit practical requirements, removing bottlenecks, and clearing resources is necessary, but it is necessary to strictly comply with legal regulations to protect the legitimate rights of land users. This is a big, sensitive, and complicated issue, directly related to human rights and civil rights, and is one of the causes that can give rise to complicated and prolonged complaints and lawsuits; affecting people's social security and livelihoods.
Therefore, land recovery must meet the requirements of real necessity for the purposes of national defense, security, socio-economic development for the national and public interest and must be public and transparent, not giving rise to inadequacies, especially new complex issues in practice, ensuring compliance with the Constitution; there must be an assessment of the impact of the policy, especially the negative impact.
Some opinions said that the addition of land recovery cases should be carefully considered, ensuring the provisions of the Constitution, avoiding affecting people's rights, should not be applied widely before a specific impact assessment, it is possible to report to competent authorities to allow the application of a pilot mechanism for a number of cases proposed by the Government to be added in localities with a National Assembly Resolution on specific mechanisms and policies, to have a basis for comprehensively amending the Land Law in the coming time.
Economic and Financial Committee of The National Assembly proposed to clarify whether to apply the price in the price list or the price agreed upon between the investor and the person whose land was previously recovered to compensate the remaining 25% of people when the State recovers land to limit the occurrence of complaints.
Through discussion, the National Assembly Standing Committee agreed with many contents in the Government's Submission and the Report of the Economic and Financial Committee; agreed with the Government's proposal to add the draft Resolution to the 2025 Legislative Program, submitting it to the National Assembly for consideration and approval according to the shortened process at the 10th Session of the 15th National Assembly.
Concluding the session, National Assembly Vice Chairman Vu Hong Thanh suggested that the Government continue to direct the review of the contents of the draft Resolution, ensuring that it closely follows and is consistent with the Party and State's guidelines and policies, especially the new resolutions of the Politburo.
During the working session, the National Assembly Standing Committee gave opinions on the draft Resolution of the National Assembly stipulating specific mechanisms on a number of guidelines and policies in Resolution No. 71-NQ/TW dated August 22, 2025 of the Politburo on breakthroughs in education and training development; gave opinions on the draft Law on National Reserves (amended) and a number of other important contents.
