
The Ministry of Home Affairs proposes that in cases of establishment, dissolution, merger, division, adjustment of boundaries and renaming of provincial-level administrative units, the provincial People's Committee shall organize to collect opinions from households in all commune-level administrative units belonging to that provincial-level administrative unit. Regarding the results of the consultation, the draft Decree stipulates that the report on the results of the consultation must show the total number of households in the area, the number of households participating in the consultation, the number of households agreeing, the number of households disagreeing, and other opinions (if any).
" If the results of the consultation on the establishment, dissolution, merger, division, adjustment of boundaries and renaming of administrative units reach the approval of more than 50% of the total number of households in the area (calculated according to each commune-level administrative unit), the project development agency will continue to complete the project and send it to the People's Councils of relevant administrative units for comments ," the draft Decree clearly states.
In cases where it has not reached 50%, the Provincial People's Committee shall direct the organization of propaganda, persuasion, mobilization and reception of valid opinions from the People to complete the Project, ensuring the approval rate of the People according to regulations.
The Ministry of Home Affairs also proposed requiring the results of public consultation to be made public on local information portals and websites and on the Government 's Electronic Information Portal.
Regarding the order and procedures for collecting public opinions on the establishment, dissolution, merger, division, boundary adjustment and renaming of administrative units, the drafting agency proposes to implement them in 4 steps.
Firstly, after developing the project, the Provincial People's Committee shall issue a document with the Opinion Collection Form and opinion collection documents to the Commune People's Committee; direct and guide the Commune People's Committee to organize the collection of public opinions in each village and residential group.
Second, within 60 working days from the date of receiving the document from the Provincial People's Committee, the Commune People's Committee shall complete the collection of public opinions.
Third, within 5 working days from the date of completion of the consultation, the People's Committee at the commune level shall synthesize and prepare a report on the results of the consultation with the people in the area and send it to the People's Council at the same level and the People's Committee at the provincial level.
Fourth, within 5 working days from the date of receiving the report on the results of collecting people's opinions from the People's Committee at the commune level, the People's Committee at the provincial level shall synthesize and prepare a report on the results of collecting people's opinions in the area and send it to the People's Council at the provincial level.
