Adjusting special allowances and regional allowances after administrative unit arrangement

New communes formed from old communes with different allowance levels, the allowance level of the new commune must not exceed the allowance level of the old commune with the highest allowance level.

According to the Ministry of Home Affairs, in order to have a basis for reviewing and deciding on amending the guidelines for implementing the regional allowance regime and the special allowance regime to suit the 2-level local government model (replacing the previous 3-level local government model), the Ministry of Home Affairs issued Document No. 2942/BNV-CTL&BHXH dated May 27, 2025 to 63/63 provinces and cities to review and propose special allowances and regional allowances.

Based on the review results, the proposals of 63/63 provinces and cities before the reorganization are different. Some localities propose to keep the allowances unchanged, while others propose to apply higher or increase the allowances compared to the current level.

In the condition of not yet implementing salary reform, rearranging types of salary allowances according to Resolution No. 27-NQ/TW dated May 21, 2018 of the 7th Central Conference of the 12th Term, the Ministry of Home Affairs synthesizes and plans to amend the List of areas receiving allowances in the direction of.

Firstly, new communes formed from old communes with the same allowance level will maintain the allowance level of the old commune.

Second, if a new commune is formed from old communes with different allowance levels, the allowance level of the new commune must not exceed the allowance level of the old commune with the highest allowance level.

Third, do not combine the review of allowances to supplement new ones or adjust the increase in allowances of new communes (if old communes do not have allowances, new communes will not have allowances either; do not raise the allowance level of new communes higher than the allowance level of old communes).

The Ministry of Home Affairs requests the People's Committees of provinces and centrally-run cities to direct the Department of Home Affairs to preside over and coordinate with the Department of Finance, the Department of Ethnic Minorities and Religions and relevant agencies, based on current regulations, to continue reviewing and balancing reasonable special allowances and regional allowances for new commune-level areas after the arrangement (from 63 to 34 provincial-level administrative units); especially reviewing the names of communes and units under their management, ensuring compliance with legal regulations.

Provinces and cities are responsible for the results of the review, balancing of allowance levels and names of localities and units receiving allowances under their management.

Along with the review work, the Ministry of Home Affairs also sent comments from 63 provinces and cities on two draft Circulars including: Circular amending instructions for implementing special allowance regime; Circular amending instructions for implementing regional allowance regime.

The results of comments will be an important basis for the Ministry of Home Affairs to complete and submit to competent authorities for promulgation, creating a clear and unified legal corridor in applying special allowances and regional allowances for cadres, civil servants and public employees at the commune level after the administrative unit arrangement.
