In Resolution No. 68-NQ/TW issued on May 4, 2025 on private economic development, the Politburo made a breakthrough when it first specifically mentioned intangible assets (intellectual property rights, brands, data, software, etc.), and at the same time required a review and full institutionalization of rights to this type of asset.
The decisive factor for sustainable development
Because in the strong flow of the 4.0 industrial revolution, protecting and effectively exploiting intangible assets is not only a legal issue but also a decisive factor for the sustainable development of businesses and the country's economy .
In Vietnam, although awareness has improved, the legal system and enforcement mechanism still have gaps and have not kept up with the speed of development and complex changes of intangible assets.
Current regulations mainly focus on protecting intellectual property rights, lacking a comprehensive mechanism for development and exploitation; valuation and financialization mechanisms for intangible assets are unclear, making it difficult for businesses to put brands, copyrights or patents into accounting books, and even more difficult to use them as collateral for loans.
Not to mention, the sanctions for violations are not strong enough, the fines are dozens of times lower than the profits earned from the violations, sometimes violators just consider this as "business costs".
In addition, the system of courts and arbitration specializing in intellectual property is only in its infancy, not really meeting the requirements of professional capacity, procedures are still lengthy, and appraisals are complicated, thereby causing intellectual property rights infringement to remain widespread.
This not only erodes business confidence and stifles innovation, but also prevents intellectual resources from being effectively exploited, limiting the competitiveness of the Vietnamese economy in the international arena.

Urgent request
The early and full institutionalization of rights to intangible assets, in the spirit of Resolution No. 68-NQ/TW, is an urgent and strategic requirement. To do so, it is necessary to first build a standard valuation system, allowing intangible assets to be used as capital contributions, mortgages for loans or investments; at the same time, perfecting the insurance and transaction mechanisms, helping businesses easily transfer intellectual property rights or exploit data safely.
The establishment of a specialized court for intellectual property disputes would be an important step, ensuring prompt and fair handling and application of measures to compensate for damages.
At the same time, improving the capacity of law enforcement agencies and judicial reform are also prerequisites. Synchronously implementing these measures will create a solid legal environment, encourage private enterprises to invest in research and development, attract foreign investment, promote technology transfer and commercialize innovation.
From there, it helps to enhance the position of Vietnamese enterprises in the global value chain, turning intangible resources into tangible strength, helping the Vietnamese economy truly "take off" in the digital age.
