
Recently, the Ministry of Home Affairs has proactively reviewed the system of job positions for civil servants and public employees in administrative agencies, organizations, and public service units managed by the Government after the arrangement, organization of the apparatus, administrative units, and implementation of two-level local government.
Accordingly, after ministries, branches and localities completed the reorganization of the apparatus and administrative units according to Resolution No. 18-NQ/TW and Conclusion No. 121-KL/TW, the Ministry of Home Affairs proactively coordinated with ministries managing sectors and fields to review the system of lists of civil servant job positions prescribed in the Circulars guiding job positions of ministries managing sectors and fields to determine the list of civil servant job positions expected to be implemented, as a basis for ministries, branches and localities to review and complete the Job Position Project of agencies and organizations, in accordance with the functions, tasks and organizational structure of agencies and units after the reorganization of the apparatus and administrative units and the implementation of 2-level local government.
According to official dispatch 9478/BNV-CCVC, the Ministry of Home Affairs proposed dividing positions into 3 groups at the commune level: Leadership and management positions; professional and technical civil servants; and support and service positions.
For the leadership and management group, the Ministry plans to have 8 positions, including chief of office, deputy chief of office of People's Council and People's Committee; head and deputy head of specialized department; director and deputy director of Public Administration Service Center; commander and deputy commander of Commune-level Military Command.
In addition, the Ministry of Home Affairs also oriented 32 professional and technical civil servant positions according to the functions and tasks of the new commune level.
Pursuant to relevant legal provisions to suit the practical operations of commune-level authorities, in addition to the 28 job positions oriented in Official Dispatch 7415/BNV-CCVC, the Ministry of Home Affairs plans to add 4 job positions.
The first is the position of assisting the People's Council, arranged at the People's Council and People's Committee offices at the commune level.
Second, the chief accountant/accountant, arranged in specialized departments and public administrative service centers under the People's Committees at the commune level, is identified as an accounting unit or budget unit according to the guidance of the Ministry of Finance . At the same time, the position of an accountant is adjusted to match the arrangement of the position of chief accountant or accountant.
Third is the job position of receiving citizens, handling complaints, denunciations, and preventing corruption.
Finally, there is the position of specialized inspector (as prescribed in Clause 2, Article 6 of Decree No. 217/2025/ND-CP.
Thus, the number of job positions used at the commune level is 43 (including 8 leadership and management positions; 32 professional and technical positions arranged by industry and field and 3 support and service positions). The number of these positions increases by 4 positions compared to the orientation in Official Dispatch No. 7415/BNV-CCVC.





According to the provisions of the Law on Cadres and Civil Servants 2025, job position is the sole basis for arranging, using and managing civil servants. Civil servants in any job position must undertake the work and be assigned the corresponding salary scale.
In addition, the Law on Cadres and Civil Servants 2025 stipulates: "No later than July 1, 2027, ministries, branches, central and local agencies must complete the job placement and rank assignment corresponding to the job position for civil servants recruited before the effective date of this Law."
The Ministry of Home Affairs is researching and drafting a Decree regulating civil servant positions and organizing the implementation of the arrangement, use and management in accordance with the spirit of the Law on Cadres and Civil Servants 2025.
In particular, the draft Decree focuses on the basic contents: The Government promulgates a list of civil servant job positions for unified implementation in state agencies from the central to commune levels; The Government stipulates the form of job description and the framework of job position capacity; Ministries, branches and localities base on this list, the form of job description and the framework of job position capacity prescribed by the Government and base on the functions and tasks according to the new organizational structure to develop the Project of job positions of agencies and organizations under their management.





Based on the functions and tasks of the new commune level, the Ministry of Home Affairs plans to develop a list of job positions at the new commune level (along with job descriptions and competency frameworks for each job position at the new commune level).
From there, localities directly apply and develop the Project on civil servant job positions at the commune level to determine the payroll, which is the basis for recruiting, using, and managing civil servants at the commune level under their management authority.
