The draft Law on State Budget (amended) has come closer to real life.

Giving specific comments on some contents, at point a, clause 2, Article 10 of the draft Law, delegate Duong Khac Mai suggested studying and removing the phrase " not yet budgeted " at the end of this point because in reality, some expenditure tasks were budgeted at the beginning of the year, but in reality, the implementation increased due to fluctuations in prices, scale, and quantity, so it is necessary to add more funds from the reserve fund for timely implementation.

Delegate Duong Khac Mai participated in the discussion on the draft Law on State Budget (amended) at the 9th Session, 15th National Assembly.

At point h, clause 9, Article 30 of the Draft Law stipulates that the Provincial People's Council " Determines specifically or assigns the Provincial People's Committee to decide on a number of regimes, standards, and budget expenditure norms according to the framework regulations of the Government or the Ministry of Finance in accordance with the balancing capacity of the local budget". However, at point a, clause 2, Article 21 of the Law on Promulgation of Legal Documents 2025 stipulates that "The Provincial People's Committee shall issue a decision to stipulate: a) Details of articles, clauses, points and other contents assigned in legal documents of superior state agencies". Therefore, in case the draft Law is actually applied, the Provincial People's Committee will register, draft, appraise, examine and submit to the Provincial People's Council for consideration and promulgation of a legal resolution to assign the Provincial People's Committee to decide on a number of regimes, standards, and budget expenditure norms according to the framework regulations of the Government or the Ministry of Finance; After that, the process of building the QPPL Decision of the Provincial People's Committee will continue to be regulated. Thus, the actual time to build the resolution will be longer, the process will be doubled instead of submitting it to the Provincial People's Council for direct regulation. Therefore, the delegate suggested studying and providing guidance in the documents detailing the implementation of the Law on Promulgation of Legal Documents for this case so that when implemented, it can be effective and administrative procedures can be shortened.

In Clause 2, Article 35 of the draft Law stipulating the revenue sharing and percentages between the central budget and local budgets, delegate Duong Khac Mai agreed with option 2, because the revenue sources in localities can often change due to fluctuations in the domestic and international situation affecting the economic development of the whole country in general and each locality in particular. In order to create initiative in budget management and promptly carry out assigned tasks, it is appropriate to assign the Government to develop a plan and submit it to the National Assembly for decision. If specific regulations are made for each locality in the law as in option 1, when there is even the smallest change, the Law must be amended, the process will take a long time and will not respond promptly to actual developments.

At point c, clause 3, Article 63 of the draft Law regulating the source transfer, delegate Duong Khac Mai proposed to study and revise " Expenditures for which bidding work has been completed according to the Law on Bidding before December 31 of the year of budget implementation ". Because in reality, many expenditure tasks are completed by the end of the year with bidding and bid evaluation but are not transferred, so there is no budget allocated for implementation, leading to complaints and lawsuits from contractors for not complying with the provisions of the Law on Bidding.
