According to Government Decree No. 33 dated June 10, 2023, the total number of commune-level officials and civil servants allocated, based on commune classification and specific factors, is a maximum of 5,157 people; the total number of part-time personnel allocated at the commune level is a maximum of 3,199 people.
Meanwhile, in Resolution 68 dated December 29, 2023, the Provincial People's Council allocated 4,998 commune-level officials and civil servants and 3,040 commune-level permanent staff members to 18 districts, towns, and cities in 2024. In explaining to the Provincial People's Council for consideration and approval of Resolution 68, the Provincial People's Committee stated that a review of the allocation and utilization of officials and permanent staff members at the commune level showed relatively stable figures.
In 2024, the district and commune-level administrative units of the province will implement restructuring in accordance with Conclusion No. 48 dated January 30, 2023 of the Politburo and Resolution No. 35 dated July 12, 2023 of the Standing Committee of the National Assembly.
Therefore, to ensure stability in the arrangement and facilitate the resolution of the surplus number of civil servants and registered public employees at the commune level after the reorganization of administrative units, the Provincial People's Committee submits to the Provincial People's Council a decision on the allocation of the number of civil servants and registered public employees at the commune level for each district-level administrative unit in 2024 according to the classification of administrative units; not including the allocation of additional civil servants and registered public employees at the commune level based on specific factors.
In practice, and according to the 2023 survey results, some localities have allocated significantly fewer civil servants and public employees than the number assigned under Resolution 68.
For example, Tam Ky City has only deployed 258/281 civil servants and 119/168 assigned permanent staff; Dai Loc has deployed 354/378 civil servants and 188/224 assigned permanent staff; Nui Thanh has deployed 343/360 civil servants; Duy Xuyen has deployed 273/292 civil servants… According to statistics, the entire province has only utilized 4,740/4,998 civil servants and 2,732/3,040 assigned permanent staff.
The Department of Internal Affairs acknowledges that some localities have not yet allocated the full number of commune-level personnel as stipulated in Resolution No. 68 dated December 29, 2023, of the Provincial People's Council.
However, the proposal to the Provincial People's Council to allocate an additional 159 civil servants and 159 permanent staff members at this session (to meet the number stipulated in Decree 33) aims to facilitate localities in arranging and assigning personnel to carry out their assigned tasks.
Especially in the commune-level administrative units in the eastern part of the province, there is a great need for more personnel to carry out local work, such as managing land status, land clearance, and handling legal procedures related to land administration and construction...
Furthermore, it is necessary to allocate the entire additional number of civil servants and additional registered public employees based on specific characteristics to districts, towns, and cities so that localities can transfer and arrange the surplus number to commune-level administrative units within their areas appropriately, and to minimize the pressure of dealing with the surplus number after the reorganization of administrative units in the province.
During the period 2023-2025, Quang Nam province plans to reorganize 2 district-level administrative units (Nong Son and Que Son) and 10 commune-level administrative units; it is estimated that 114 district-level officials and civil servants will be redundant (44 in the Party sector and 70 in the State sector), and 148 commune-level officials and civil servants will be redundant after the reorganization (including 102 officials and civil servants and 46 commune-level civil servants).
An increase of 85 commune-level administrative units.
In Report 5010 dated July 5, 2024, the Provincial People's Committee stated that, after reviewing the current situation of the increase in the number of civil servants and registered public employees at the commune level due to specific factors, all of them belong to commune-level administrative units with large population sizes (for communes, wards, and towns in the plains) and large natural areas (for communes and towns in mountainous areas).
In 85/241 commune-level administrative units with specific characteristics, the majority (70 units) saw an increase of 1 to 2 civil servants and 1 to 2 registered public employees; the increase of 3 to 5 civil servants and 3 to 5 registered public employees (12 units) was mainly in communes and towns such as Nam Phuoc (Duy Xuyen), Ha Lam (Thang Binh), Ai Nghia (Dai Loc), and some communes and wards in Dien Ban town.
Notably, three units saw significant increases in personnel: Dien Ngoc ward (Dien Ban district) with 9 civil servants and 9 registered employees; Tam Hai commune (Nui Thanh district) with 11 civil servants and 11 registered employees; and Thanh My town (Nam Giang district) with 13 civil servants and 13 registered employees.
Given the practice of localities allocating fewer civil servants and public employees than assigned, Ms. Duong Thi Thanh Hien, Deputy Head of the Legal Affairs Committee of the Provincial People's Council, stated that additional allocations should only be made in areas where there is a pressing need. Some opinions on this matter also suggested that a suitable roadmap should be studied instead of allocating the maximum allowed amount, as the province is currently implementing a roadmap for administrative unit restructuring.
Ms. Tran Thi Kim Hoa, Director of the Department of Internal Affairs, stated that the number of civil servants and commune-level officials is determined by the Government according to the classification of communes, wards, and towns; it does not fall under the category of downsizing according to Conclusion No. 40 dated July 18, 2022, of the Politburo on improving the efficiency of personnel management of the political system in the period 2022-2026.
The Provincial People's Committee's proposal to allocate an additional 159 civil servants and 159 commune-level administrative staff members, increasing the number based on population size and natural area in 85 commune-level administrative units, has a legal basis.
According to Resolution No. 68 dated December 29, 2023, localities that are not reorganizing district-level and commune-level administrative units in the 2023-2025 period are drafting plans to recruit additional commune-level personnel to meet the assigned quota.
In agreement with the proposal of the Provincial People's Committee, the Legal Affairs Committee of the Provincial People's Council noted that the rearrangement of commune-level administrative units will lead to a large surplus of civil servants and public employees in some communes subject to rearrangement (148 people).
Therefore, after being approved by the Provincial People's Council, during the implementation process, the Provincial People's Committee directed the Department of Internal Affairs to coordinate with the district-level People's Committees to develop solutions for managing and effectively utilizing the quantity and quality of civil servants and additional assigned personnel at the commune level to achieve the goal of supplementing human resources to perform tasks without creating pressure in resolving surplus due to the reorganization of administrative units.
