The report on the draft law presented by Minister of Industry and Trade Nguyen Hong Dien said that the law was built to institutionalize the Party's guidelines and policies and the State's policies on perfecting the institution on e-commerce. Institutionalize and internalize international commitments on e-commerce. Unify the legal system on e-commerce in relation to other laws, ensuring the unity and synchronization of the legal system.

At the same time, it is necessary to resolve difficulties, problems, shortcomings and limitations in the implementation of legal documents on e-commerce in recent times as well as to adapt to the innovation trend due to digital technology that has changed and reshaped all areas of the economy , including the e-commerce sector.

Perfecting policies and laws on e-commerce in the direction of encouraging innovation in the development and implementation of regulations, ensuring stability, unity, synchronization, transparency and feasibility; protecting the legitimate rights and interests of consumers; creating motivation for competition and creative development of enterprises; supporting and encouraging the activities of social organizations, while improving the effectiveness and efficiency of state management of e-commerce; creating conditions for e-commerce to develop sustainably and orderly, as a driving force for the development of the digital economy.

The Law is built on the viewpoint: Ensuring full institutionalization of the Party's guidelines and policies, the State's policies; in accordance with the Constitution and relevant legal provisions. Ensuring compliance with the Constitution and relevant legal provisions; strictly complying with the provisions of the Law on Promulgation of Legal Documents and relevant guiding documents; in accordance with reality, feasible, creating favorable conditions for implementation in practice.

Innovate thinking in law-making in the direction of ensuring the requirements of state management while encouraging creativity, liberating all productive forces, and opening up all resources for development. Legal provisions must be stable and have long-term value. Laws only regulate framework issues and issues of principle.

Selectively refer to and inherit current regulations and international experiences suitable to Vietnam's practices; ensure consistency of regulations with the legal system and compatibility with relevant international commitments of which Vietnam is a member.

The law not only aims to overcome shortcomings and limitations in management and enforcement practices, but also plays a leading role, paving the way, unlocking social resources, creating a favorable legal corridor for innovation and developing new models. In the field of e-commerce, special attention should be paid to the requirements of developing green, sustainable e-commerce, aiming at environmental protection, enhancing social responsibility and promoting digital transformation associated with inclusive development.

The scope of regulation of the Law regulates the conclusion of contracts in e-commerce; types and responsibilities of entities in e-commerce activities; responsibilities of organizations providing e-commerce support services; e-commerce development; application of technology in e-commerce management; dispute resolution, inspection and handling of violations in e-commerce.

The Law on E-commerce applies to domestic and foreign organizations and individuals participating in e-commerce activities in Vietnam.

The draft Law is designed to include 7 Chapters and 48 Articles, specifically regulating the e-commerce platform and responsibilities of entities in e-commerce activities; responsibilities of organizations providing e-commerce support services; e-commerce development; application of technology in e-commerce management; dispute resolution, inspection and handling of violations in e-commerce...

The draft Law closely follows 6 approved policies, including: Regulations on types and responsibilities of entities participating in e-commerce activities; regulations on types and responsibilities of entities participating in multi-service digital platforms and social networks with e-commerce activities; regulations on types and responsibilities of entities participating in cross-border e-commerce activities without a presence in Vietnam, foreign investment activities in the e-commerce sector in Vietnam, foreign sellers with e-commerce activities in Vietnam; regulations on e-commerce support services and responsibilities of related entities; perfecting the legal framework on contract conclusion in e-commerce; promoting green and sustainable e-commerce development...
