The report on the Draft Law presented by Minister of Foreign Affairs Le Hoai Trung said that the development of the Draft Law is an urgent requirement to overcome limitations and obstacles that are "bottlenecks" in the process of implementing the Law on International Treaties (ITT).
Focusing on: promptly institutionalizing the Party and State's policies according to relevant resolutions issued recently. Supplementing specific regulations, shortening the procedures for signing international treaties to meet political , foreign affairs and operational requirements of senior leaders. Regulating the order and shortened procedures for signing international treaties on official development assistance (ODA) loans and foreign concessional loans. Clarifying a number of provisions in the Law on International Treaties to ensure consistent application of the law.
The draft Law is developed in accordance with the order and procedures prescribed by the Law on Promulgation of Legal Documents and guiding documents. It amends and supplements 22 out of 80 articles of the 2016 Law on International Cooperation, adds 2 new articles, abolishes 2 articles; amends and supplements 2 articles of the Law on Government Organization.
The main contents focus on 3 issues. Specifically, one is to regulate the order and procedures for negotiating, signing, approving, ratifying, amending, supplementing, extending and implementing international treaties on ODA and preferential loans in accordance with the provisions of the law on public debt management; supplementing and clarifying the provisions on submitting for approval, concluding negotiations, amending and supplementing international treaties, and archiving signed records.
Second is to shorten the time, eliminate procedures, simplify the dossier for signing international treaties; supplement the order and shorten the procedures; increase the initiative of the proposing agency; regulate the posting of international treaties on the electronic Official Gazette.
Third is the decentralization from the Government to the Prime Minister in deciding and submitting to the President for decision on the work of signing international treaties. Decentralization from the Prime Minister to the head of the agency proposing the decision on the issue of delegation to attend international conferences.
In some special cases, the Prime Minister proposes that the President authorize the Prime Minister to decide on negotiating, signing, amending and supplementing international treaties under the President's authority. Regarding this content, taking into account the concluding opinions of the National Assembly Standing Committee and the review opinions, the Party Committee of the Ministry of Foreign Affairs reported and asked for the opinion of the Politburo and the Politburo agreed with this provision in the draft Law.
