Enhancing workers' rights through collective bargaining agreements

Over the years, Thanh Hoa trade unions at all levels have always identified CLAs as an effective means, the "key" to ensuring the rights and interests of union members and employees.

Vice Chairman of the Provincial Fatherland Front Committee, Chairman of the Thanh Hoa Provincial Labor Federation Vo Manh Son said: Implementing the Resolution of the 13th Congress of the Vietnam General Confederation of Labor and the 20th Congress of the Thanh Hoa Provincial Labor Federation, the Provincial Labor Federation identified consulting, supporting negotiation, signing and implementation of the Collective Labor Agreement as one of the key and breakthrough tasks.

The Provincial Federation of Labor has issued Action Plan No. 190/KH-LĐLĐ on "Focusing on dialogue and collective bargaining to bring benefits to union members and employees", in which it strives to have at least 92% of enterprises and units with trade unions sign the Collective Labor Agreement; by the end of 2028, at least 85% of enterprises and units with trade unions are qualified to represent and negotiate and sign the Collective Labor Agreement in accordance with the provisions of law. The Provincial Federation of Labor focuses on directing and guiding grassroots unions to play a good role as a bridge between workers and business owners, proactively proposing to employers to negotiate, sign and amend and supplement the Collective Labor Agreement with more beneficial contents for employees and in accordance with the capabilities and conditions of enterprises. This is an important legal basis for trade unions to protect the legitimate rights and interests of union members and employees.

In order to raise awareness and responsibility of trade unions at all levels in implementing the collective bargaining agreement well, improve the quality of collective bargaining agreements with the aim of bringing benefits higher than the provisions of the law to union members and employees, and attract more and more employees to participate in the Vietnam Trade Union, the Provincial Federation of Labor has issued Instruction No. 14/HD-LĐLĐ on assessing and classifying the quality of collective bargaining, signing and implementing collective bargaining agreements of trade unions at all levels. Up to now, 100% of grassroots trade unions under the Provincial Federation of Labor have implemented Instruction No. 14/HD-LĐLĐ. In addition, every year, the Provincial Federation of Labor organizes many training courses on negotiation skills and signing collective bargaining agreements for trade union officials; sends officials to training courses, trains lecturers and experts on collective bargaining, signing and implementing collective bargaining agreements at the Vietnam General Confederation of Labor level. Directing grassroots trade unions to coordinate with the authorities and professional counterparts to organize the implementation of democratic regulations, strengthen dialogue at enterprises, and build harmonious, stable and progressive labor relations in enterprises. As a result, 14/14 state-owned enterprises and 910/910 non-state-owned enterprises organized dialogue conferences at the workplace; 72/65 enterprises proposed and negotiated with employers to adjust the value of shift meals to increase by over VND 18,000 (reaching 110.7%); 14/14 state-owned enterprises organized labor conferences; 680/680 non-state-owned enterprises organized labor conferences...

In order to improve the quality of collective labor agreements, the trade union has recently innovated the process, form, content of negotiation and signing to have real labor agreements, in which laborers are involved throughout the process of building, negotiating, signing and implementing. The contents of the collective labor agreement are mainly benefits for laborers, the most common being allowances for laborers in difficult circumstances, allowances for funerals, weddings, sickness, maternity; some agreements stipulate shift meals, rest hours, occupational safety and hygiene... The total number of units with collective labor agreements is 306 units (reaching a rate of 37%) with 217,440 laborers benefiting from signing the collective labor agreement; the number of units that have not signed the collective labor agreement is 520 units, accounting for a rate of 63%. Currently, 14/14 State-owned enterprises, 122/122 foreign-invested enterprises and 189 domestic enterprises have seriously implemented the Collective Labor Agreement. In general, enterprises have seriously implemented the Collective Labor Agreement.

To better perform the task of caring for, representing and protecting the legitimate and legal rights and interests of union members and employees, in the coming time, trade unions at all levels will continue to raise awareness among union members, employees, union officials and partners about the role and importance of dialogue and collective bargaining. Organize collective bargaining at many levels, with many partners; expand coverage; improve the quantity and quality of collective bargaining agreements; continue to build and promote the role of union officials at all levels in dialogue and collective bargaining; strengthen training, fostering, negotiation skills, and signing of collective bargaining agreements for grassroots union officials. At the same time, proactively coordinate with relevant agencies to strengthen inspection, examination and supervision of the negotiation, signing and implementation of collective bargaining agreements in enterprises, contributing to building harmonious and stable labor relations, improving the lives of employees, and developing production and business of enterprises.
