On the afternoon of November 10, the National Assembly discussed in groups the draft Law on the Capital (amended). Participating in giving comments, delegate Ta Thi Yen ( Dien Bien delegation) expressed her agreement with the necessity of promulgating the Law on the Capital (amended) with the basic contents as in the Government's submission.

Commenting on the organization of the capital's government apparatus (Chapter II), delegate Ta Thi Yen agreed with the proposed regulations in the draft Law on the government model at all levels of Hanoi Capital in the direction of maintaining and stabilizing it as in the 2021-2026 term according to Resolution No. 97/2019/QH14 of the National Assembly and Decree No. 32/2021/ND-CP of the Government.

"I agree with the promotion of decentralization for the city government in regulating a number of contents in the fields of organizational structure and staffing, considering this an important breakthrough, creating a premise for the city to implement specific mechanisms and policies in the draft Law," said Ms. Yen.

Regarding the number of staff, according to Ms. Yen, we should focus on improving the quality of civil servants and public employees in accordance with the requirements of Resolution No. 15 of the Politburo on the development orientation of Hanoi Capital to 2030, with a vision to 2045.

That is to build Hanoi into a smart, modern city with a streamlined, modern, effective and efficient administrative apparatus, suitable for the role, position and requirements of the capital's governance in the new development stage on the basis of e-government, applying digital technology in the capital's governance.

Therefore, delegates believe that there needs to be clearer and more specific regulations on which agency has the authority to decide on the payroll. Where does the reserve payroll come from?

Ms. Yen said that if the current draft Law stipulates that the City People's Council must propose to the competent authority to decide specifically on the number of additional staff, it is still unclear and unclear.

Therefore, she proposed to study the regulation in the direction of "assigning the City People's Council to proactively decide on the staffing of cadres, civil servants and public employees based on the framework of job positions approved by competent authorities and meeting the requirements of performing the tasks of the City government".

"Such a regulation will help the City be more proactive in terms of staffing resources, and can increase or decrease staffing in each period, depending on the specific situation and practical needs of the locality," said the delegate.

Increasing the number of delegates is appropriate to the population size.

Regarding the number of Hanoi People's Council delegates, the draft Law stipulates an increase from 95 to 125 delegates; increasing the proportion of full-time People's Council delegates to at least 25%, which is considered a necessary solution to improve the capacity, professionalism and operational efficiency of the People's Council.

According to delegate Ta Thi Yen, increasing from 2 to 3 Vice Chairmen of the City People's Council and expanding the composition of the Standing Committee of the People's Council compared to the provisions of the Law on Organization of Local Government is also quite suitable to improve the quality and efficiency of the People's Council's operations.

However, it is also possible to further study the innovation of the working methods of the City People's Council to further improve the professionalism, quality and efficiency of this institution's operations.

She also agreed with the regulation to increase the number of full-time People's Council delegates by 25%, thereby increasing the number of People's Council delegates from 95 to 125 delegates, on the grounds that Hanoi has the second largest population in the country.

However, the delegates found that with the development of digital government, digital society, and digital citizens, the forms, methods, and tools of representation should also be considered in the direction of digitalization and representation, and the rights of voters and people of the capital so that the apparatus can be implemented better and more effectively.

Delegate, Venerable Thich Bao Nghiem (Hanoi delegation) also assessed that this draft Law closely followed the provisions of Resolution 15 of the Politburo on the direction and tasks of developing the Capital until 2030, closely followed the 9 groups of policies in the proposal to build the Capital Law approved by the Government, synthesized existing problems and shortcomings in implementing the Capital Law (2012) to build specific policies with high feasibility.

The delegate also assessed that the draft focused on decentralization and delegation of authority to define the responsibilities of the Capital. To promote the role of the community and the People's Council, the draft stipulated that it was necessary to increase the number of People's Council delegates (125 delegates).

“This number is even lower than the national average. Moreover, the forecasted population of Hanoi is higher than the planned population (the adjusted plan to 2030 is not 9.2 million people but could be up to 14 million), so further research is needed,” said Venerable Thich Bao Nghiem.

According to the delegate, the draft mentioned the City government within the City (Articles 13-14 of the draft) which is necessary. However, he said that the draft still stated many general principles but did not mention specific policies to promote the role of this new government model such as the role of selecting investors, signing project contracts, adjusting local planning, using public assets...

From there, the delegate suggested referring to lessons learned from Thu Duc City under Ho Chi Minh City and decisions approved by the National Assembly for Thu Duc City (in Resolution 98/2023/QH15 on piloting special mechanisms and policies for the development of Ho Chi Minh City).

Promoting the advantages of high-quality human resources

Venerable Thich Bao Nghiem also emphasized that Hanoi's potential for knowledge and high-quality human resources is enormous. Hanoi has about 70% of the country's knowledge, nearly 80 universities and many national research institutes. Therefore, it is necessary to gather and promote advantages.

According to him, this is also the content identified as the main task and solution in Resolution 15 of the Politburo. Of the 8 tasks mentioned, 3 specifically mention the requirement: Mobilizing and effectively using resources and potentials in culture, science, technology...

According to the delegate, the draft mentioned a number of specific policies such as: prioritizing the development of a number of fields, budget support policies, forming national centers... However, it is still not complete compared to Resolution 15 and Resolution 27 on building a team of intellectuals.

“It is recommended to consider and supplement some specific contents such as budget allocation and incentives in implementing key science and technology tasks. Incentives in transferring and applying science and technology, and in preserving urban heritage,” Venerable Thich Bao Nghiem stated .
