The Hanoi People's Procuracy recently issued an indictment against the defendant Duong Van Toan (86 years old, residing in Hoang Mai District, Hanoi) for the crime of raping a person under 16 years old. The victim was a girl A. (born in 2016, residing in Ngoc Thuy Ward, Long Bien District, Hanoi).
According to the indictment, on the late afternoon of June 30, 2022, the defendant Toan returned from taking out the trash and saw A. (a neighbor) wearing a pink and white dress playing in front of the house. Seeing the girl, the defendant had a sexual desire.
After observing that there was no one around, the defendant Toan called A. into his house. There, the defendant groped and sexually assaulted the girl. After committing the crime, the defendant put pants and a skirt on the victim and told her to go home.
The next day, A. told her mother about the incident. Immediately, the family took her to the defendant Toan's house for questioning. The defendant said, "If I did anything wrong to your child, please forgive me. I won't do it again."
A.'s mother reported the incident to Ngoc Thuy Ward Police. Long Bien District Police then began investigating, examining the scene, and requesting a sexual forensic examination to clarify the crime.
Forensic examination results confirmed that there was no semen sample on the victim's body. Defendant Toan currently lives in a nursing home in Long Bien District and is under preventive measures, prohibiting him from leaving his place of residence.
The defendant was prosecuted for the crime of raping a person under 16 years old, according to the provisions of Point c, Clause 3, Article 142 of the 2015 Penal Code (amended and supplemented in 2017), with a penalty of 20 years, life imprisonment or death penalty.
