(Chinhphu.vn) - The Ministry of Health is drafting a Circular regulating the decentralization of the implementation of a number of tasks and the settlement of administrative procedures in the field of disease prevention under the authority of the Ministry of Health.

Proposal to decentralize the handling of administrative procedures in the field of disease prevention under the authority of the Ministry of Health to the Department of Disease Prevention

According to the Ministry of Health , the issuance of the Circular on decentralization of the implementation of a number of tasks and settlement of administrative procedures in the field of disease prevention is consistent with the Government's policy on promoting decentralization and delegation as prescribed in the Law on Organization of the Government and the Law on Organization of Local Governments, aiming to:

Responding to the requirements of perfecting the decentralization and delegation of authority: currently, a number of state management tasks of the Ministry of Health have been assigned to the Departments and Divisions for implementation but have not been uniformly and fully regulated by legal documents. The issuance of the decentralization Circular will create a unified legal basis for implementing these tasks, ensuring legality, rationality and transparency.

Decentralization of handling administrative procedures in the field of disease prevention under the authority of the Ministry of Health to the Department of Disease Prevention

The draft clearly states that the implementation of a number of tasks and the settlement of a number of administrative procedures in the field of disease prevention under the authority of the Ministry of Health is delegated to the Department of Disease Prevention, including:

1. Carry out the tasks assigned by the Ministry of Health in Clause 2, Article 12 of the Law on Prevention and Control of the virus causing acquired immunodeficiency syndrome in humans (HIV/AIDS) regarding the responsibility to preside over and coordinate with relevant agencies in providing accurate and scientific information on HIV/AIDS.

2. Carry out the tasks assigned by the Ministry of Health in Clause 5, Article 3 of Decree No. 141/2024/ND-CP dated October 28, 2024 of the Government on providing and promulgating instructions on condom use in harm reduction interventions to prevent HIV infection.

3. Carry out the tasks assigned by the Ministry of Health in Clause 5, Article 4 of Decree No. 141/2024/ND-CP on providing and promulgating guidelines for the use of clean syringes and needles in harm reduction interventions to prevent HIV infection.

4. Perform the tasks assigned by the Ministry of Health at Point a, Clause 1, Article 13 of Decree No. 63/2021/ND-CP dated June 30, 2021 of the Government on promulgating technical guidance on HIV counseling and testing.

5. Perform the tasks assigned by the Ministry of Health in Article 51 of Decree No. 141/2024/ND-CP.

6. Decide on health declaration and terminate the application of health declaration in Clause 1, Article 4 of Decree No. 89/2018/ND-CP dated June 25, 2018 of the Government detailing the implementation of a number of articles of the Law on Prevention and Control of Infectious Diseases regarding border health quarantine.

7. Instructions on language in medical declaration in Clause 2, Article 6 of Decree No. 89/2018/ND-CP.

8. Direct and organize the implementation of border health quarantine in accordance with the provisions of law nationwide; Decide on the application of health declaration and termination of health declaration for people; direct and implement the implementation of health declaration for people nationwide; guide the information and reporting of border health quarantine activities in Clause 1, Article 41 of Decree No. 89/2018/ND-CP.

9. Guidance on handling human outbreaks at Point a, Clause 2, Article 8 of Joint Circular No. 16/2013/TTLT-BYT-BNNPTNT dated May 27, 2013 of the Ministry of Health and the Ministry of Agriculture and Rural Development on guidance on coordination in preventing and controlling diseases transmitted from animals to humans.

10. Develop and guide the implementation of programs, plans and activities on preventing and combating the harmful effects of alcohol and beer in Clause 2, Article 16 of Decree No. 24/2020/ND-CP dated February 24, 2020 of the Prime Minister detailing a number of Articles of the Law on Prevention and Combating the Harmful Effects of Alcohol and Beer.

11. Focal point for developing the content of sample documents and standard documents on preventing and combating the harmful effects of alcohol and beer to serve the work of information, education, communication and coordination of guidance and implementation nationwide; organizing the provision of scientific information, advising people and the community on the harmful effects of alcohol and beer, the levels of risk when drinking alcohol and beer, subjects, diseases, health conditions that are not allowed to drink alcohol and beer, measures to reduce the harmful effects of alcohol and beer in Clause 3, Article 16 of Decree No. 24/2020/ND-CP.

12. Professional guidance on screening, early detection and prevention services in Clause 4, Article 16 of Decree No. 24/2020/ND-CP.

13. Inspect and urge the implementation of local activities to prevent and combat the harmful effects of alcohol and beer in Clause 6, Article 16 of Decree No. 24/2020/ND-CP.

14. Provide guidance, collect information, build a database and report on the use of chemicals, insecticides and disinfectants for household and medical use according to the provisions of law at Point d, Clause 2, Article 160 of Decree No. 08/2022/ND-CP dated January 10, 2022 of the Government detailing a number of articles of the Law on Environmental Protection.

15. Carry out the tasks assigned by the Ministry of Health in Article 22 of Decree No. 104/2016/ND-CP dated July 1, 2016 of the Government regulating vaccination activities as amended and supplemented by Decree No. 155/2018/ND-CP and Decree No. 13/2024/ND-CP dated February 5, 2024 of the Government.

16. Perform the tasks assigned by the Ministry of Health in Clause 1, Article 6 of Decree No. 217/2025/ND-CP dated August 5, 2025 of the Government on specialized inspection activities.

17. Report on the implementation of environmental protection tasks of the Ministry of Health in Item d, Clause 1, Article 118 of the Law on Environmental Protection 2020.

18. Carry out other tasks of the Ministry of Health regarding the organization of appraisal and signing of decisions approving the outline and reporting on the results of environmental protection tasks of units using the Ministry of Health's environmental protection career budget (according to the annual requirements of the Ministry of Agriculture and Environment).

19. Granting license to import medical specimens (TTHC code 2.001229) according to regulations in Article 36 of Decree No. 89/2018/ND-CP amended and supplemented in Clause 2, Article 15 of Decree No. 155/2018/ND-CP.
