LIST AND ASSIGNMENT OF AGENCIES IN CHAIR OF DRAFTING DOCUMENTS DETAILED REGULATIONS ON IMPLEMENTATION OF LAWS AND RESOLUTIONS PASSED BY THE 15TH NATIONAL ASSEMBLY AT THE 9TH SESSION
This Decision allows the application of simplified procedures and processes for a number of documents such as: Decree detailing a number of articles and measures to implement the Law on Vietnamese Nationality; Decree regulating the organization and operation of the People's Public Security Inspectorate; Decree amending and supplementing a number of articles of Decree No. 31/2021/ND-CP dated March 26, 2021 of the Government detailing and guiding the implementation of a number of articles of the Investment Law; Decree detailing the removal of obstacles for BOT traffic projects; Decree detailing the overall technical design, specific mechanisms, and special implementation of railway projects; Decree detailing Resolution No. 204/2025/QH15 dated June 17, 2025 of the National Assembly on value-added tax reduction...
Ministries and ministerial-level agencies are responsible for proposing the issuance of documents according to the simplified procedure and ensuring that opinions are obtained from subjects directly affected by the documents.
The Minister is responsible for the content of the proposal to issue detailed regulations.
The Decision clearly states the responsibilities of the heads of ministries and ministerial-level agencies regarding the content of the proposed issuance of detailed regulations, specifically: Ministers and heads of ministerial-level agencies are responsible for the content of the proposed issuance of detailed regulations, ensuring that the content assigned to the detailed regulations is complete, within the authority and time limit for issuance of the document to take effect at the same time as the law, resolution or content assigned to the detailed regulations. For detailed regulations that have not yet determined the specific provisions of the detailed regulations, the agency assigned to preside over the drafting of the document shall report to the competent authority during the drafting of the detailed regulations to ensure that the issuance of the detailed regulations is within the authority, complete, accurate in the content assigned to the detailed regulations, the effective date of the detailed regulations and take full responsibility for the proposal of its agency.
In case of need to change or supplement the proposal, the Minister or Head of the ministerial-level agency shall report to the Government Leader in charge of the industry or field for consideration and decision.
Review each unit and head for slow issuance or issuance of documents that do not ensure quality.
In addition, the Decision also clearly states the responsibilities of ministries and ministerial-level agencies in implementing and promulgating documents detailing the implementation of laws and resolutions. Specifically:
The Ministry of Justice shall preside over and coordinate with ministries and ministerial-level agencies to develop and submit to the Prime Minister for promulgation a Plan to implement the Law amending and supplementing a number of articles of the Law on Handling of Administrative Violations No. 88/2025/QH15, clearly identifying the documents that need to be issued to detail this Law.
The Ministry of Home Affairs shall preside over and coordinate with ministries and ministerial-level agencies to develop and submit to the Prime Minister for promulgation a Plan to implement the Law on Organization of Local Government No. 72/2025/QH15, clearly identifying the documents that need to be issued to detail this Law.
The Minister and Head of the ministerial-level agency in charge of drafting detailed regulations are responsible for:
- Directly in charge, direct and be responsible to the Government and Prime Minister for the quality and progress of drafting and promulgating detailed regulations according to this Decision.
- Regularly urge and check the implementation progress; review and clarify the responsibilities of each unit and the head assigned to preside over the drafting and submission of documents to avoid delays in issuance or issuance of documents that do not ensure quality.
- Proactively coordinate with the Ministry of Justice, the Government Office and relevant agencies to promptly resolve within their authority or report to the Prime Minister and Deputy Prime Minister in charge of the field for instructions on issues arising beyond their authority.
- Concentrate resources, promptly complete and submit to competent authorities for promulgation of detailed regulations and instructions for the implementation of Resolution No. 198/2025/QH15 of the National Assembly on a number of special mechanisms and policies for private economic development under the direction of the Government in Resolution No. 139/NQ-CP dated May 17, 2025 on the Plan to implement Resolution No. 198/2025/QH15 dated May 17, 2025 of the National Assembly on a number of special mechanisms and policies for private economic development.
Speed up the appraisal and processing of draft documents
The Ministry of Justice speeds up the appraisal process; the Government Office speeds up the processing of draft documents submitted by ministries and ministerial-level agencies to the Government and Prime Minister.
The Ministry of Justice shall coordinate with the Government Office to monitor, urge and inspect the issuance of detailed regulations; report and recommend the Prime Minister to consider and handle the responsibilities of ministries and ministerial-level agencies for the delay in issuing detailed regulations.
Ministries and ministerial-level agencies, within the scope of their functions and tasks, shall review documents to amend, supplement, replace, abolish, and issue new documents within their authority or submit them to competent authorities for promulgation, ensuring appropriate and timely implementation of laws and resolutions passed by the 15th National Assembly at the 9th Session.
