Promoting democracy in amending the 2013 Constitution

(GLO)- In order to promote the people's mastery, mobilize the intelligence and enthusiasm of all people and create high consensus and unity in society, the National Assembly organized to collect people's opinions on the draft Resolution amending and supplementing a number of articles of the 2013 Constitution.

Many enthusiastic and highly constructive opinions have been recorded, clearly reflecting the legitimate aspirations of people at the grassroots level.

Many thoughtful and practical suggestions

At the conference to collect opinions on the draft Resolution amending and supplementing a number of articles of the 2013 Constitution held by the Standing Committee of the Vietnam Fatherland Front Committee of Gia Lai province on May 15, a number of experts and scientists contributed many profound and responsible opinions.

Clause 3, Article 2 of the draft stipulates that “…In special cases, it is allowed to appoint personnel who are not People's Council delegates to hold leadership positions of People's Councils at the provincial and communal levels formed after the arrangement”.

Regarding this content, Associate Professor - Doctor Nguyen Danh - Chairman of the Provincial Union of Science and Technology Associations - suggested: It is necessary to consider and limit special cases as much as possible, because if there are too many, the concept of special will lose its meaning.

In addition, it is necessary to stipulate decentralization and delegation of power in the draft Resolution on the competent authority deciding on special cases allowing the appointment of personnel who are not People's Council delegates to hold leadership positions of People's Councils at the provincial and communal levels formed after the rearrangement.

Associate Professor-PhD Nguyen Danh also suggested considering and adding the phrase "central agency of the Vietnam Trade Union or the Vietnam General Confederation of Labor " before the phrase "representing workers at the national level in labor relations and international relations on Trade Unions" in Article 10 to be more concise.

Chairman of the Socio -Economic Advisory Council of the Vietnam Fatherland Front Committee of the province Nguyen Xuan Anh commented on the content in Clause 1, Article 110. Specifically, regarding the provision: "Administrative units of the Socialist Republic of Vietnam include provinces, centrally run cities and administrative units below provinces and centrally run cities", Mr. Anh said that the current writing does not clearly show the 2-level government.

"Administrative units of the Socialist Republic of Vietnam include provinces, centrally run cities, communes, wards, and special zones" remove the phrase "administrative units below provinces and centrally run cities" - Mr. Anh suggested.

Regarding Clause 2, Article 115, Mr. Anh also proposed to maintain the current regulations on the right to question of People's Council delegates to the Chief Justice of the People's Court and the Chief Prosecutor of the People's Procuracy. Because, if amended, People's Council delegates will only have the right to question the Chairman of the People's Committee, other members of the People's Committee and heads of agencies under the People's Committee.

Sharing the same view, Dr. Tran Trung - Deputy Head of the Democracy-Law Advisory Council (Vietnam Fatherland Front Committee of the province) also said: This is to ensure the mechanism of controlling state power among competent agencies, organizations and individuals in the locality in exercising judicial power and supervising judicial activities.

According to Mr. Trung, when the district-level administrative unit ends its operation, the district-level People's Court and People's Procuracy will no longer be organized, but will be replaced by the regional People's Court and People's Procuracy (not attached to a specific administrative unit), so there will be no People's Council at the same level to exercise the right to question. Therefore, there needs to be an appropriate organizational mechanism so that People's Council delegates can question the Chief Justice of the People's Court in case an incident occurs in the area.

Collect public opinion transparently and effectively

The Draft Resolution consists of 2 articles. Article 1 consists of 8 clauses amending and supplementing a number of provisions of the 2013 Constitution on the Vietnam Fatherland Front and socio-political organizations, on administrative units and local government organizations. Article 2 consists of 3 clauses regulating the effective date and transitional provisions.

The subjects of the consultation are people of all walks of life; agencies, organizations, the Vietnam Fatherland Front Committee of the province and its member organizations, experts and scientists. The content of the consultation is the entire draft Resolution amending and supplementing a number of articles of the 2013 Constitution.

In parallel with organizing conferences, many agencies and units also apply information technology to expand the reception channel, creating the most favorable conditions for people of all walks of life to promote their ownership rights, participate in contributing opinions proactively, transparently and promptly. In particular, integrating the feature of giving opinions to amend and supplement a number of articles of the Constitution on the VNeID application with a specific step-by-step process helps people access conveniently, easily implement and ensure transparency.

Chairwoman of the Provincial Women's Union Ro Cham H'Hong said: The Union has developed a plan to collect opinions from female cadres and members on the draft Resolution amending and supplementing a number of articles of the 2013 Constitution. The focus is on the provisions of the 2013 Constitution related to the Vietnam Fatherland Front, socio-political organizations, and local government organization models; in which, focusing on contributing opinions on the contents of amendments and supplements in Article 9, Article 10, Clause 1 (Article 84), Article 110, Clause 2 (Article 111), Clause 2 (Article 112), Clause 1 (Article 114), Clause 1 (Article 115) of the 2013 Constitution, closely following the guidelines and orientations on the scope of amendments and supplements approved at the 11th Conference of the 13th Party Central Committee.

“In terms of form, the Association organizes conferences to collect opinions directly at the agency; at the same time, encourages female members to give their opinions directly on the VNeID application, on the official websites of the National Assembly, the Government and in conferences, seminars, discussions, member activities, club activities, activities of models, teams, groups... to ensure that all female members can participate conveniently and effectively" - said the President of the Provincial Women's Union.

Amending and supplementing a number of articles of the 2013 Constitution is an urgent requirement in the current context to create a constitutional basis for implementing the revolution in streamlining the organizational apparatus, building, perfecting, and improving the effectiveness and efficiency of the political system.

According to the plan of the Provincial People's Committee, the consultation will be completed on May 25. In order to ensure that the draft Resolution is consistent with reality and accurately reflects the thoughts and aspirations of the people, the comments will be received and synthesized in an objective, scientific and serious manner. This is an important basis for completing the draft Resolution before submitting it to the National Assembly for consideration and approval in the coming time.
